7.SUBRECIPIENTMONITORINGa.TheDepartmentwillmonitortheactivitiesoftheSubrecipientfromawardtocloseout.ThegoaloftheDepartment'smonitoringactivitieswillbetoensurethatagenciesreceivingfederalpass-throughfundsareincompliancewiththisAgreement,federalandstateauditrequirements,federalgrantguidance,andapplicablefederalandstatefinancialregulations,aswellas2CFRPart200SubpadF.b.Todocumentcompliancewith2CFRPart200SubpartFrequirements,theSubrecipientshallcompleteandreturntotheDepartmentthe"2CFRPart200SubpartFAuditCellificationForm"locatedathttp://mil.wa.govlemergencv-management-division/qrants/requiredqrantformswiththesignedAgreementandeachfiscalyearthereafteruntiltheAgreementisclosed,whichisincorporatedbyreferenceandmadeapartofthisAgreement.c.Monitoringactivitiesmayinclude,butarenotlimitedto:i.Reviewoffinancialandperformancereports;ii.MonitoringanddocumentingthecompletionofAgreementdeliverables;iii.Documentationofphonecalls,meetings,e-mails,andcorrespondence;iv.ReviewofreimbursementrequestsandsupportingdocumentationtoensureallowabilityandconsistencywithAgreementWorkPlanandBudget(Attachment2),andfederalrequirements;v.ObservationanddocumentationofAgreement-relatedactivities,suchasexercises,training,fundedevents,andequipmentdemonstrations;andvi.On-sitevisitstoreviewequipmentrecordsandinventories,toverifysourcedocumentationforreimbursementrequestsandperformancereports,andtoverifycompletionofdeliverables.d.TheSubrecipientisrequiredtomeetorexceedthemonitoringactivities,asoutlinedaboveandin2CFRPart200,foranynon-federalentitytowhichtheSubrecipientmakesasubawardasapass-throughentityunderthisAgreement.e.Compliancewillbemonitoredthroughoutthepedormanceperiodtoassessrisk.ConcernswillbeaddressedthroughaCorrectiveActionPlan.8.LIMITEDENGLISHPROFICIENCY(CIVILRIGHTSACTOF1964TITLEVI)TheSubrecipientmustcomplywiththeTitleVIoftheCivilRightsActof1964(TitleVI)prohibitionagainstdiscriminationonthebasisofnationalorigin,whichrequiresthatSubrecipientsoffederalfinancialassistancetakereasonablestepstoprovidemeaningfulaccesstopersonswithlimitedEnglishproficiency(LEP)totheirprogramsandservices.ProvidingmeaningfulaccessforpersonswithLEPmayentailprovidinglanguageassistanceservices,includingoralinterpretationandwrittentranslation.ExecutiveOrder13166,improvingAccesstoServicesforPersonswithLimitedEnglishProficiency(August11,2000),requiresfederalagenciestoissueguidancetorecipients,assistingsuchorganizationsandentitiesinunderstandingtheirlanguageaccessobligations.DHSpublishedtherequiredrecipientguidanceinApril2011,DHSGuidancetoFederalFinancialAssistanceRecipientsRegardingTitleVIProhibitionagainstNationalOriginDiscriminationAffectingLimitedEnglishProficientPersons,76Fed.Reg.21755-21768,(April18,2011).TheGuidanceprovideshelpfulinformationsuchashowarecipientcandeterminetheextentofitsobligationtoprovidelanguageservices,selectinglanguageservices,andelementsofaneffectiveplanonlanguageassistanceforLEPpersons.Foradditionalassistanceandinformationregardinglanguageaccessobligations,pleaserefertotheDHSRecipientGuidanceathttps:llwww.dhs.gov/quidance-published-help-department-supported-organizations-provide-meaninqful-access-people-limitedandadditionalresourcesonhttp://www.lep.cov.9.NIMSCOMPLIANCEa.TheNationalIncidentManagementSystem(NIMS)identifiesconceptsandprinciplesthatanswerhowtomanageemergenciesfrompreparednesstorecoveryregardlessoftheircause,size,location,orcomplexity.NIMSprovidesaconsistent,nationwideapproachandvocabularyformultipleagenciesorjurisdictionstoworktogethertobuild,sustain,anddeliverthecorecapabilitiesneededtoachieveasecureandresilientnation.DHS-FEMA-HSGP-SHSP-FFY18Page7of38KittitasCountySheriffsOffice,E21-187
