The Director of Public Works and/or the County Engineer or his/her designee shall have the authority, on <br />behalf of the County, to ascertain that all design and construction complies with the requirements set forth <br />in these Standards. <br />It shall be the duty of the Board of County Commissioners, acting through the Director of Public Works or <br />his/her designee, to enforce the provisions of this title. <br />12.01.060 Violations and Penalties. <br />The County shall have the authority to impose penalties and take other specific actions in response to <br />violations of the code and non-compliance with these standards. <br />A. The County may withhold or withdraw approval of project plans, require the forfeiture of the <br />financial guarantee submitted to the County, and/or issue non-acceptance of portions of the work. <br />B. The County may require the applicant or property owner to remove or replace illegal earthwork <br />and/or other items associated with these standards that were not properly permitted. <br />C. The County shall have the authority to enforce these standards including the design and <br />construction guidance that is referenced in this section. The County will appoint project engineers, <br />assistants, and inspectors as necessary to inspect the work and they will exercise such authority as <br />the Director of Public Works and the County Engineer may delegate. <br />D. Stop Work Orders: Should the County become aware of conditions that invalidate the original <br />design data used to obtain the permit or determine that the applicant is not complying with the <br />conditions of the permit, the approved plans, or applicable portions of these standards, the County <br />may revoke the original permit and/or order work stopped on the project. Examples of reasons why <br />the County may order all or part of the permitted work stopped include but are not limited to the <br />following: <br />1. The applicant failed to comply with the conditions of the permit, the approved plans, SEPA or <br />other environmental permit conditions, or applicable portions of these standards; <br />2. The permit was granted on the basis of erroneous or incomplete information submitted to <br />the county by the applicant or the applicant's engineer or agent; <br />3. Weather conditions caused off-site or downstream drainage problems; <br />4. The work has created, is adjacent too, or otherwise associated with, a condition that is a <br />hazard to life, endangers property, or adversely affects the use or stability of a public way or <br />drainage course. <br />E. Cease and Desist Orders: The County may serve a cease and desist order for violations of this <br />chapter. The order shall include the following: <br />1.
