D. Obtaining coverage under this permit <br />All operators of regulated small MS4s are required to apply for and obtain coverage <br />in accordance with this section, unless waived or exempted in accordance with <br />section S1.C. <br />1. Unless otherwise noted, the term "Permittee" includes a city, town or county <br />Permittee, New Permittee, Co -Permittee, Secondary Permittee, and New <br />Secondary Permittee, as defined below: <br />a. A "Permittee" is a City, Town or County owning or operating a regulated <br />small MS4 and receiving a permit as a single entity. <br />b. A "New Permittee" is a City, Town or County that is subject to the <br />Eastern Washington Phase II Municipal Stormwater General Permit and <br />was not subject to the permit prior to August 1, 2014. <br />C. A "Co -Permittee" is any owner or operator of a regulated small MS4 that <br />is applying in a cooperative agreement with at least one other applicant for <br />coverage under this permit. A Co -Permittee owns or operates a regulated <br />small MS4 located within or in proximity to another regulated small MS4. <br />d. A "Secondary Permittee" is an operator of a regulated small MS4 that is <br />not a City, Town or County. Secondary Permittees include special purpose <br />districts and other MS4s that meet the criteria for a regulated small MS4 in <br />S LB above. <br />e. A "New Secondary Permittee" is a Secondary Permittee that is covered <br />under a municipal stormwater general permit and was not covered by the <br />permit prior to August 1, 2014. <br />2. Operators of regulated small MS4s have submitted or shall submit an <br />application to Ecology by either the Notice of Intent (NOI) for Coverage under <br />National Pollutant Discharge Elimination System (NPDES) Municipal <br />Stormwater General Permit provided in Appendix 5; or the Duty to Reapply — <br />NOL <br />a. The following Permittees and Secondary Permittees submitted a Duty to <br />Reapply- NOI to Ecology prior to August 19, 2011: <br />i. Cities and Towns: Asotin, Clarkston, East Wenatchee, Ellensburg, <br />Kennewick, Moses Lake, Pasco, Pullman, Richland, Selah, Spokane, <br />Spokane Valley, Sunnyside, Union Gap, Walla Walla, Wenatchee, <br />West Richland, Yakima <br />ii. Counties: Asotin County, Chelan County, Douglas County, Spokane <br />County, Walla Walla County, Yakima County <br />iii. Secondary Permittees: Central Washington University, Eastmont <br />Metropolitan Park District, Port of Benton, Selah School District <br />#119, Sunnyside Valley Irrigation District, Washington State <br />Eastern Washington Phase II Municipal Stormwater Permit —August 1, 2014 <br />Page 4 <br />
