Y <br />1r WASHINGTON STATE <br />Recreation and RCO Project Agreement <br />Conservation Office For Office Administered Programs <br />Project Sponsor: Kittitas County Public Works Project Number: 16-1860C <br />Project Title: Ringer hoop Acquisitions and Design Approval Date: 7/9/2016 <br />A. PARTIES OF THE AGREEMENT <br />This Project Agreement (Agreement) is entered into between the State of Washington the Recreation and <br />Conservation Office, P.O. Box 40917, Olympia, Washington 98504-0917 and Kittitas County by and through the Kittitas <br />County Public Works (sponsor), 411 N Ruby St Ste 1, Ellensburg, WA 98926 and shall be binding on the agents and <br />all persons acting by or through the parties. <br />B. PURPOSE OF AGREEMENT <br />This Agreement sets out the terms and conditions by which a grant is made to implement projects under the Yakima <br />Integrated Plan of the State of Washington. The grant is administered by the Recreation and Conservation Office <br />(RCO) to the sponsor for the project named above per the director's authority granted in RCW 79A.25.020, <br />C. DESCRIPTION OF PROJECT <br />Kittitas County will acquire fee simple title to one 40 acre and one 20 acre property, they will acquire a conservation <br />easement on a third 60 acre property, and they will obtain an appraisal to acquire a forth 20 acre property. All <br />properties are located along the Ringer Loop reach of the Yakima River, south of Ellensburg. In addition, Kittitas <br />County will complete preliminary designs and permits for a habitat restoration project on the 60 acre conservation <br />easement. The goal of the project is to protect and expand riparian habitat and to facilitate future off channel fish <br />habitat enhancement and road decommissioning. Fish that are targeted to benefit from the project include steelhead, <br />spring Chinook, Coho, Sockeye, and Cutthroat Trout, <br />D. PERIOD OF PERFORMANCE <br />The period of performance begins on February 29, 2016 (project start date) and ends on June 1, 2017 (project end <br />date). No allowable cost incurred before or after this period is eligible for reimbursement unless specifically provided <br />for by written amendment or addendum to this Agreement or specifically provided for by policies published in RCO <br />manuals as of the effective date of this agreement. <br />The sponsor must request extensions of the period of performance at least 60 days before the project end date. <br />The sponsor has obligations beyond this period of performance as described in Section E: On-going Obligations. <br />E. ON-GOING OBLIGATIONS <br />For the acquisition portion of this project, the sponsor's on-going obligations shall be in perpetuity and shall survive the <br />completionitermination of this Project Agreement unless otherwise identified in the Agreement or as approved by the <br />funding board. It is the intent of the funding board's conversion policy (see Section 24: Restriction of Conversion) that <br />all lands acquired and or facilities and areas developed, renovated, or restored with funding assistance remain in the <br />public domain in perpetuity. <br />For the planning portion of this project, the sponsor's on-going obligation shall be the same as the period of <br />performance identified in Section D: Period of Performance. <br />F. PROJECT FUNDING <br />The total grant award for this project shall not exceed $988,452.00. RCO shall not pay any amount beyond that <br />approved for grant funding of the project and within the RCO's percentage as identified below. The sponsor shall be <br />responsible for all total project costs that exceed this amount.
