H. RIGHTS AND OBLIGATIONS INTERPRETED IN LIGHT OF RELATED DOCUMENTS <br />All rights and obligations of the parties under this Agreement shall be interpreted in light of the information provided in <br />the sponsor's application and the project summary under which the Agreement has been approved as well as <br />documents produced in the course of administering the Agreement, including the eligible scope activities and <br />milestones report incorporated herein by reference. Provided, to the extent that information contained in such <br />documents is inconsistent with this Agreement, it shall not be used to vary the terms of the Agreement, unless those <br />terms are shown to be subject to an unintended error or omission. This "Agreement" as used here and elsewhere in <br />this document, unless otherwise specifically stated, has the meaning set forth in the definition of the Standard Terms <br />and Conditions. <br />I. AMENDMENTS MUST BE SIGNED IN WRITING <br />Except as provided herein, no amendment/deletions of any of the terms or conditions of this Agreement will be <br />effective unless provided in writing and signed by both parties. Except, extensions of the period of performance and <br />minor scope adjustments need only be signed by RCO's director or designee, unless the consent of the sponsor to an <br />extension is required by its auditing policies, regulations, or legal requirements, in which case, no extension shall be <br />effective until so consented. <br />J. COMPLIANCE WITH APPLICABLE STATUTES, RULES, AND RCFB-SRFB POLICIES <br />This agreement is governed by, and the sponsor shall comply with, all applicable state and federal laws and <br />regulations, including any applicable policies published in RCO manuals as of the effective date of this agreement, all <br />of which are incorporated herein by this reference as if fully set forth. <br />K. SPECIAL CONDITIONS <br />1. Source of Funding <br />Funding for this agreement comes from the Washington State Department of Ecology's Yakima Basin Integrated Plan <br />I <br />unds through RCO interagency agreement #17-15. <br />2. Preliminary Title Reports Required <br />Before any reimbursement is made, the sponsor must submit the preliminary title report for the subject property within <br />the scope of work approved in this Project Agreement. <br />3. Archaeological and Cultural Resource Consultation, EO 05-05 Exemption due to no ground disturbance: <br />This project does not include ground disturbing activities, nor alter structures built more than 50 years ago, and <br />therefore appears to be exempt from Governor's Executive Order 05-05 Archaeological and Cultural Resources <br />Consultation as described in Section 8 of this project agreement. If any ground disturbance or demolition or <br />modification of structures older than 50 years becomes necessary, promptly notify your RCO grant manager as <br />cultural resources consultation will be required. Completion of this consultation and a Notice to Proceed from RCO <br />will be required before these activities can begin. <br />4. Design Deliverables. <br />Appendix D of RCO Manual #18, Salmon Recovery Grants, dated January 2015, defines Conceptual, Preliminary, <br />and Final Design deliverables as follows. <br />Preliminary Project Design <br />While the detailed scope of each project's preliminary design process is unique, in general, the process for <br />developing a preliminary design includes: preparing surveyed site plans; conducting field investigations of hydrologic, <br />geotechnical, and other site conditions; conducting data analysis; preparing drawings and designs; preparing the <br />design report; and preparing engineering cost estimates. <br />Preliminary designs must adequately describe all proposed project elements in sufficient detail for permit review and <br />authorization. While the design team may tailor the design process to suit the unique circumstances of each project, <br />the following are required deliverables for preliminary designs. <br />A. Preliminary design report, drawings, and engineering cost estimate (refer to Manual 18, Appendix D-2 for a <br />detailed description of typical design report elements) <br />B.
