an inverted siphon, thus daylighting the creek, improving fish passage and removing the need for <br />the County owned bridge on North Ferguson Road; <br />WHEREAS, the District worked to secure funding to construct the project and did so <br />through Salmon Recovery Funding Board Grant #11-1525 "Coleman Cr - Ellensburg Water <br />Company Project", an Ecology Water Quality Grant #G1400580, Ecology Integrated Plan Grant <br />#G140063 8, and BPA funds through Yakima Tributary Access & Habitat Program; <br />WREx EAS, the District entered into an agreement with the EWC that includes <br />provisions stating that EWC will own and maintain the project after construction, that EWC will <br />contribute $20,000 toward completion of the project; and that EWC will obtain necessary <br />easements for construction; <br />WIHEREAS, the completed acquisition of the necessary easements in September 2015, <br />with assistance from the County and their real estate consultants who completed an appraisal of <br />the remaining easement location; <br />WYEREAS, the District advertised the Ellensburg Water Company at Coleman Creek <br />project for bid on September 17, 2015 and received bids on October 12, 2015; <br />WHEREAS, the low responsive and responsible bid amount, in addition to the <br />associated construction costs (engineering assistance, daily observer and other staff costs, and a <br />reasonable construction contingency) exceeds the District's current budget for the project; <br />WHEREAS, the County desires to complete removal of the North Ferguson Road bridge <br />over the EWC canal and can do so by contributing funds to construction of the project; <br />NOW, THEREFOR E, the parties agree as follows: <br />1. PURPOSE. The purpose of this Agreement is to complete construction of the <br />Ellensburg Water Company at Coleman Creek project. <br />2. ADMINISTRATION. No new separate legal or administrative entity is created to <br />administer the provisions of this Agreement. <br />a.
