!N --k ERG VER'IK K NTA:, C DCP RA'r -GN AG- T+'EMEN 1 <br />BETWEEN KITTrrAS COUNTY AND <br />KITTITAS COUNTY CONSERVATION ,DISTRICT <br />FOR ELLENSBURG WATER COMPANY AT COLEMAN CREEK PROJECT <br />k I AF,.EE is made and entered into this day of <br />2015, between KITTITAS COUNTY, a political subdivision of <br />the State of Washington, and the KITTITAS COUNTY CONSERVATION DISTRICT ("the <br />District"), a political subdivision of the State of Washington. <br />W-1 Y IST,SS 1 1 14: <br />WHEREAS, the Interlocal Cooperation Act, as amended, and codified in chapter 39.34 <br />of the Revised Code of Washington ("RCW"), provides for public agencies to enter into <br />agreements for joint or cooperative action authorized under that chapter; <br />WHEREAS, the County and the District are public agencies within the meaning of <br />chapter 39.34 RCW; <br />WHEREAS, chapter 89.08 RCW specifically provides for the District to enter into <br />interlocal agreements; <br />WHEREAS, the District's mission is to provide leadership, technical, educational and <br />financial assistance to landowners and land users in their utilization and management of natural <br />resources; <br />NMEREAS, the District serves the citizens of the community (county, state, country) to <br />ensure the long term use of natural resources in an economically, socially and environmentally <br />sustainable maimer using non -regulatory, voluntary approaches; <br />WHEREAS, the Ellensburg Water Company (EWC) requested the assistance of the <br />District to complete a project on Coleman Creep including two work sites, one where the EWC <br />canal intersects the creek immediately adjacent to North Ferguson Road and another where the <br />EWC legally diverts irrigation water from Coleman Creek; <br />WHEREAS, the District complete a design process in 2010 with Salmon Recovery <br />Funding Board grant 08-1949 "Coleman Creek Irrigation Redesign" and through that process <br />conducted several technical work group meetings in which the Kittitas County Engineer <br />participated; <br />WHEREAS, the completed design includes modifying the EWC canal intersection with <br />Coleman Creek so that the canal passes under the creek and the adjacent North Ferguson Road in <br />
