totheadministrationandregulationoftheuse,occupancy,anddevelopmentofPublicLands.c.TodetainpersonssuspectedofviolatingWashingtonStatelaws,regulations,orKittitasCountyordinances,anywitnessestothoseviolations,andtoprotectanyrelatedcrimescene,pendingarrivalofthestateorlocalagencyhavingprimaryjurisdiction.d.Toarrest,transport,andreleasetoanavailablestateorlocallawenforcementofficeranypersonhavingavalidStateorlocalwarrantforhis/herarrestwhenrequestedbytheKittitasCountySheriffsOffice.V.SCOPEANDCONDITIONSA.Neitherpartyshallbeliabletotheotherortoitsagentsoremployeesforanyloss,damage,personalinjury,ordeathoccurringinconsequenceoftheperformanceofthisMOU,exceptasprovidedherein.B.Nomemberof,ordelegatetoCongress,orStateOfficial,shallbeadmittedtoanyshareorpartofthisMOU,oranybenefitthatmayarisetherefrom.C.RangerNicoulinwillremainunderthesupervisionandresponsibilityoftheBLM.RangerNicoulinshallnotbeconsideredascomingwithinthescopeoftheKittitasCountySheriff'sOfficeemploymentandnoneofthebenefitsofKittitasCountySheriff'sOfficewillbeconferredunderthisMOU.D.DuringtheperformanceofthisMOU,theparticipantsagreetoabidebythetermsofExecutiveOrder11246onnondiscriminationandwillnotdiscriminateagainstanypersonbecauseofrace,color,religion,sex,age,disability,ornationalorigin.Theparticipantswilltakeaffirmativeactiontoensurethatapplicantsareemployedwithoutregardtotheirrace,color,religion,sex,age,disability,ornationalorigin.E.Eachpartywillfurnishwritteninformationnecessaryformutualenforcementoperations.F.AnyissueswhichcannotbereconciledbetweentheKittitasCountySheriff'sOfficeandRangerNicoulinoranyissuethataffectseitherparty'sperformanceunderthisMOUshallbereferredtotheSAC.TheSACwillberesponsibleforcoordinatingwiththeappropriateofficialstomutuallyresolveanyissue.G.NothinginthisMOUwillbeconstruedasaffectingtheauthoritiesofeitherpartyorasbindingbeyondtheirrespectiveauthorities.H.NothinginthisMOUshallobligatetheBLMtoexpendappropriationortoenterintoanycontractorotherobligation.Specificworkprojectsoractivitiesthatinvolvethetransferoffunds,service,orpropertybetweenthepartiestothisMOUwillrequiretheexecutionofseparateagreementsorcontracts,contingentuponAttachment6-4
