theavailabilityoffundsasappropriatedbyCongress.Eachsubsequentagreementorarrangementinvolvingthetransferoffunds,service,orpropertyshallbemadeinwritingandshallbeindependentlyauthorizedbyappropriatestatutoryauthorityandregulations,includingthoseapplicabletoprocurementactivities.I.Subjecttoavailabilityoffunds,eachpartyagreestofundtheirownexpensesassociatedwiththeimplementationofthisMOU.NothingcontainedhereinshallbeconstruedasobligatingtheBLMtoanyexpenditureorobligationoffundsinexcessorinadvanceofappropriations,inaccordancewiththeAnti-DeficiencyAct,31U.S.C.§1341.J.AnyrecordsordocumentsgeneratedasaresultofthisMOUshallbepartoftheofficialBLMrecordmaintainedinaccordancewithapplicableBLMRecordsManagementpolicies.AnyrequestforreleaseofrecordsassociatedwiththeimplementationofthisMOUtoanyoneoutsidethepartiesmustbedeterminedbasedonapplicablelaws,includingtheFreedomofInformationActandthePrivacyAct.K.ThisMOUshallbeeffectivefromthedateofexecutionandshallremainineffectuntilterminatedwitha60-daywrittennoticefromeitherpartytotheotherparty.ThisMOUmaybemodifiedoramendeduponwrittenrequestofeitherpartyandwrittenconcurrenceoftheotherparty.L.ThisAgreementshallbefiledasrequiredbyRCW39.34.040uponratification.VI.APPROVEDClaytonMyersJoseLinaresKittitasCountySheriffStateDirector(Acting),Oregon/WashingtonBureauofLandManagementDateDateAttachment6-5
