letter will be provided by Suncadia Water Company, LLC <br />Tom Miller <br />Tom Miller comment letter requests additional review on behalf of Suncadia Water Company regarding <br />water use of the proposed lakes within the boundaries of the plat. <br />Response: <br />The applicant understands the concern, and, as noted per the Department of Health comments, will adhere <br />to all applicable regulations as outlined in the Development Agreement. The applicant confirms the current <br />water capacity systems allows for the proposed lake feature. <br />Kittitas County Building Department <br />The Kittitas County Building Department references the property boundary is adjacent to steep slopes that <br />may exceed 33.3%, and all buildings placed near these slopes may require special geotechnical engineering <br />when exceeding setback limitations in the International Residence Code. In addition, all construction of <br />buildings and garages shall conform to the International Buildings and International Residence Codes <br />adopted at the time of building permit submittal. <br />Response: <br />The applicant has engaged Icicle Creek Engineering, the geotechnical expert reviewing slopes and <br />qualifying slope conditions as found within the plat boundaries. As such under the guidance of Icicle <br />Creek setback limitations will apply. The applicant acknowledges the applicable internal code references <br />at the time of building permit, and will comply. <br /> <br />DAHP <br />The Department of Archeology and Historic Preservation highlighted the sensitivity of archaeological <br />resources in the proposed project area, and agreed with the Yakima Nations request that a re-survey occur. <br />Response: <br />Cultural resource issues are addressed in conditions C 21-23 of Exhibit F-1 to the Development Agreement. <br />Mitigation measures listed within these conditions shall be applied. <br />Washington Department of Ecology <br />The Department of Ecology provided a comment letter referencing the concern regarding sedimentation <br />turbidity and general water quality issues. Water quality protection was also recommended. <br />Response <br />The applicant will adhere to all applicable regulations outlined in the Development Agreement, the Erosion <br />Control Plan, and the MPR Conditions of Approval. <br />For construction activities, New Suncadia, LLC maintains a stormwater pollution prevention plan for the <br />entire MPR that will also be applicable to the development of Phase 3 Divisions 15 and 16. An NPDES permit <br />for MPR construction activities has been issued by the Washington State Department of Ecology (Permit No. <br />WA-005236-1). Conditions of the permit specify erosion control measures that will be used during <br />construction activities. <br />Index #31
