July 15, 2017 <br />Kittitas County <br />Community Development Services <br />411 North Ruby Street, Suite 2 <br />Ellensburg, WA. 98926 <br />Attn: Mr. Dan Carlson <br />Regarding — Marion Meadows PUD (PD -17-00001) <br />Associated Conditional Use Permit (CU -17-00001) <br />Development Agreement (DV -17-00001) <br />Long Plat (LP -17-00001) <br />Subject: Marion Meadows Access Road <br />In 2004 Easton Acres property owners were notified on a Kittitas County Community Development <br />Services letterhead & signed by a County employee that Easton Ridge Land Company had purchased <br />Lot 3 of Easton Acres to access a short plat of 4, 3 acre parcels (Easton Flats Short Plat #03-35). <br />Easton Acres CCR's are for the purpose of protecting the value and desirability of the property and <br />which shall run with the real property and be binding on all parties having any right, title or interest in <br />described properties. <br />Anything other than a single family home "requires" an amendment to the OCR's by 75% of <br />Easton Acres property owners. <br />Being somewhat naive and trusting of CDS & ERLC we did not challenge this proposal as the <br />property was zoned R-3 at that time and we were thrilled that ERLC would be developing 3 acre parcels. <br />As road and waterline construction commenced it was obvious that ERLC had other plans than a short <br />plat of 3 acre parcels as they installed 4 water line stub outs on Lot 3 of Easton Acres. <br />It was at that point we, Easton Acres Property Owners, realized we had been deceived by ERLC, <br />through CDS, in hopes that we would not challenge the access road. We also realized that there would be <br />no short plat & that the roads intention was for high density development. <br />Be advised that Easton Acres Property Owners will challenge any further construction on Lot 3 of <br />Easton Acres or any access through Lot 3 for any commercial activity. <br />Respectfully, <br />Easton Acres Property Owners — <br />Attachments - 3 <br />
