<br />Amended Development Agreement by and between Kittitas County
<br />and
<br />Ranch on Swank Creek LLC
<br />THIS DEVELOPMENT AGREEMENT ("Development Agreement") is entered into and
<br />effective this day of , 2025, by and between Kittitas County, a
<br />Political subdivision of the State of Washington ("County") and Ranch on Swauk Creek LLC, a
<br />corporation organized under the laws of the State of Washington ("Developer"). This Agreement
<br />is made pursuant to Revised Code of Washington ("RCW") 36.70B.170 and Kittitas County
<br />Code ("KCC") Chapter 15A.11.
<br />RECITALS
<br />KC 15A.11 authorizes the execution of a development agreement between the County
<br />and a person having ownership or control of real property within its jurisdiction.
<br />2. This Development Agreement by and between Kittitas County and the Developer relates to
<br />the development to be known as "Ranch on Swauk Creek" (or simply, the "Project").
<br />3. The Developer owns certain real property (the "Property") consisting of 487.43 acres, is
<br />located in an unincorporated area of Kittitas County and is accessed off of Highway
<br />97. The subject property is approximately a total of 487.43 acres and is located west of
<br />US HWY 97, and south of Ranch and Burke Roads of sections 27, 28, 33, 34 all within
<br />T 20N., R 17E., W.M. in Kittitas County, including but not limited to Parcel numbers
<br />20-17-28000-0007, -0006, -0001, -0004, -0003, -0002, -0005, 20-17-33000-0001, -
<br />0008, , -0025, -0019, -0024, -0026, 20-17-28030-0010, -0011, 20-17-28065-0001,
<br />0002, 0003, 0004, 0005, 0006, 0007, 0008, 0009, 0010, 0011, 0012, 0013, 0014, 20-
<br />17-27030-0002, -0006, -0003, and 20-17-34050-0003, 20-17-34050-0004, 20-17-
<br />34050-0008, 20-17-34050-0009 and all other parcels that contain a designated forest
<br />or agricultural tax designation that are required to be sold with the above listed parcels.
<br />4. On December 5, 2006, the Board of County Commissioners approved Ordinance 2006-
<br />006, granting the Ranch on Swauk Creek Planned Unit Development (RZ-06-00027),
<br />and Plat (LP-06-00027) for the Developer to pursue the Project at the site above.
<br />5. KCC 15A.11.020(2) requires a development agreement to set forth the standards and
<br />other provisions that shall apply to, govern and vest the development, use and
<br />mitigation of the development of real property for the duration specified in the
<br />agreement.
