6. For the purposes of this Development Agreement, "development standards" includes, <br />but is not limited to all of the standards listed in KCC 15A.11.020(5) and/or as <br />amended by the Ranch on Swauk Creek Final Development Plan. <br />7. KCC 15A.11.020(3) requires a development agreement to be consistent with applicable <br />county development regulations, except as such development regulations have been <br />modified by the development standards contained in the agreement. <br />8. The following events have occurred in the processing of the Developer's application: <br />a. After due notice, a public hearing was held before the Kittitas County Board of <br />County Commissioners on September 17, 2024, pursuant to KCC 15A.11.060; <br />b. The Board of County Commissioners voted to approve this Development <br />Agreement on September 17, 2024. <br />9. The "Record" supporting the development, creation, approval, or potential appeal of this <br />Development Agreement shall include all records before the Board of County <br />Commissioners in considering Ordinance No. 2006-59. <br />AGREEMENT <br />Now therefore, the parties mutually agree as follows: <br />General Provisions <br />Section 1. Definitions and Recitals. As used in this Development Agreement, the following <br />terms, words, or phrases shall have the meaning specified in this Section, unless context otherwise <br />requires. The Recitals to this Development Agreement, together with any headers or introductions <br />thereto and any definitions ascribed therein, are hereby incorporated into and shall constitute a part <br />of this Development Agreement. <br />1.1. "Adopting Ordinance" means the Ordinance that approves this Development <br />Agreement, as required by RCW 36.70B and KCC 15A.11. <br />1.2. "Administrator" means Administrative Official or Director as defined by Kittitas County <br />Code. <br />1.3. "Board" means the Kittitas County Board of County Commissioners. <br />1.4. "Certificate of Occupancy" means either a certificate issued after inspections by the <br />County authorizing a person(s) In possession of property to dwell or otherwise use a specified <br />building or dwelling unit, or the final inspection if a formal certificate is not issued. <br />1.5. "Code" means the Kittitas County Code, as it may be amended from time to time. <br />Development Agreement — Page 2 of 13 <br />
