KITTITAS COI.INTY <br />DEPARTMENT OF PUBLIC WORKS <br />AGENDA DATE: <br />ACTION REQUESTED: <br />BACKGROUND: <br />INTERACTION: <br />RECOMMENDATION: <br />HANDLING <br />ATTACHMENTS: <br />LEAD STAFF: <br />AGENDA STAFF REPORT <br />January 6,2026 <br />Request to Approve the Resolution to Ratiff the Chair of <br />County Commissioner's Signature on the Termination of <br />Trust Water Rights Purchase and Sale Agreement with <br />Suncadia Resort LLC. <br />Kittitas County maintains a water banking program that is <br />accepted by the Washington State Department of Ecology <br />(WDOE) and administered by the Public Works <br />Department. Suncadia Resort LLC wishes to sell portions <br />of its water bank. On December 23,2024, Kittitas County <br />entered into a purchase and sale agreement for the <br />beneficial interests in the water rights assigned Certificate <br />Nos. 54-837 17 -J,54-83719-J, S4-85214-J, 34-85 193-J, <br />and 54-85211-J, which was ratified by Resolution2025- <br />020. The purchase and sale agreement was contingent upon <br />receipt of funding from the WDOE, which Kittitas County <br />did not successfully obtain. As a result, Suncadia and <br />Kittitas County terminated the purchase and sale <br />agreement, and the Chair's signature on the termination <br />requires ratification. <br />Public Works. <br />Resolution to Ratify the Chair of County Commissioner's <br />Signature on the Termination of Trust Water Rights <br />Purchase and Sale Agreement with Suncadia Resort LLC. <br />Return one (1) original to Public Works. <br />Resolution <br />Arden Thomas, Water Resource Program Manager.
