J,-0ct <br />RA.TIF'YING THE CHAIR OF COUNTY CON{ISSIONER'S SIGNATT]RE ON TERMINATION <br />OF TRUST WATER RIGHTS PURCHASE AND SALE AGREEMENT WITH ST]NCADIA <br />RESORT LLC <br />WHEREAS: Kittitas County maintains a water banking program accepted by the Washington State <br />Department of Ecology and administered by the Public Works Department; and <br />WHEREAS:On December 23,2024 Kittitas County entered into a purchase and sale agreement for <br />the beneficial interests in the Water Rights assigned Certificate Nos.54-83717-J, 54- <br />83719-J, 54-85214-J, 54-85193-J and 54-8521i-J, which was ratified by Resolution <br />2025-020; and <br />WHEREAS: The Purchase and Sale Agreement was contingent on Kittitas County receiving funding <br />from Ecology in an amount sufficient to fund the total purchase price; and <br />WHEREAS: Kittitas County was not successful in a funding application to Ecology for the water right <br />purchase; and <br />WIIEREAS: The Chair of County Commissioner's signature on the Termination of Trust Water Rights <br />Purchase and Sale Agreement must be ratified. <br />NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the best interest <br />of the public, does ratiff the Chair of County Commissioner's Signature on the Termination of Trust <br />Water Rights Purchase and Sale Agreement \with Suncadia Resort LLC. <br />DATED this 6ft day of January 2026, at Ellensburg, Washington. <br />BOARD OF COUNTY COMMISSIONERS <br />COLINTY , WASHINGTON <br />Attest: <br />.@eruof the Board- Julie Kjorsvik <br />n Deputy Clqk of the Roard- \landy Buchholz
