11/01/2022 MINUTES 1 <br />COMMISSIONERS' MINUTES <br />KITTITAS COUNTY, WASHINGTON <br />AUDITORIUM <br />SPECIAL MEETING <br /> <br />TUESDAY 2:00 P.M. NOVEMBER 1, 2022 <br /> <br />Board members present: Vice-Chairman Cory Wright and Commissioner <br />Brett Wachsmith. Excused: Chairman Laura Osiadacz. <br /> <br />Others: Julie Kjorsvik, Clerk of the Board; Emily Smith, <br />Administrative Assistant; Mark Cook, Public Works Director; Josh <br />Fredrickson, Engineer; Daniel Berkshire, Judicial Assistant; and 1 <br />member of the public. <br /> <br />PUBLIC HEARING FILING FEES SUPERIOR COURT <br /> <br />At 2:00 p.m. VICE-CHAIRMAN WRIGHT opened a Public Hearing to <br />consider a request from Superior Court to add a filing fee for <br />filing of a Statement of Arbitrability and for a fee request for a <br />Trial De Novo of an Arbitration Award. <br /> <br />DANIEL BERKSHIRE, JUDICIAL ASSISTANT, reviewed a Staff Report <br />stating that the Superior Court amended its Local Rules for a civil <br />action, other than an appeal from a court of limited jurisdiction, <br />to be subject to arbitration if the sole relief sought is a money <br />judgement, and if no party asserts a claim in excess of $50,000.00, <br />exclusive of attorney’s fees, interest and costs. The proposed <br />filing fee to be assessed against the party filing a statement of <br />arbitrability would not exceed $250.00. The proposed filing fee for <br />a Trial De Novo of an arbitration award would not exceed $400.00. <br /> <br />THERE BEING NO ONE REQUESTING TO TESTIFY, THE PUBLIC PORTION OF THE <br />HEARING WAS CLOSED. <br /> <br />ORDINANCE 2022-013 FILING FEES SUPERIOR COURT <br /> <br />COMMISSIONER WACHSMITH moved to approve Ordinance No. 2022-013, <br />Directing the Adoption of Fees for Certain Superior Court Filings <br />and Adding a New Chapter to Title 4 of the Kittitas County Code. <br />VICE-CHAIRMAN WRIGHT seconded. Motion carried 2-0. <br /> <br />PUBLIC HEARING VACATE PORTION WHITE ROAD PUBLIC WORKS <br /> <br />At 2:01 p.m. VICE-CHAIRMAN WRIGHT opened a Public Hearing to <br />consider the Vacation of a portion of White Road. <br /> <br />JOSH FREDRICKSON, ENGINEER, reviewed a Staff Report and explained <br />the history of a request to vacate a portion of White Road.
