BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br /> <br />ORDINANCE NO. 2021-____ <br /> <br />AN ORDINANCE AMENDING KITTITAS COUNTY CODE TITLE 18 REGARDING <br />APPLICABILITY AND INSPECTION <br /> <br />WHEREAS, Kittitas County first adopted the Uniform Building Code and Building Code <br />Standards published by the International Conference of Building Officials on April <br />17,1984 and structures constructed prior to this date are considered legal <br />nonconforming structures; and <br /> <br />WHEREAS, Kittitas County desires to add language regarding these nonconforming structures <br />to Title 18 for clarification purposes; and <br /> <br />WHEREAS, Kittitas County Code (KCC) 18.01.060(1) currently allows staff to make inspection <br />for code enforcement from public roads or alleys but requires property owner <br />consent to enter onto private property; and <br /> <br />WHEREAS, Constitutional, statutory, and case law allows for entry onto private property under <br />certain circumstances; and <br /> <br />WHEREAS, Kittitas County recognizes a public benefit in allowing code enforcement staff to <br />access private property for inspection and public education provided such access <br />is conducted in accordance with constitutional, statutory, and case law; and <br /> <br />WHEREAS, Kittitas County staff prepared proposed amendments to Title 18 regarding legal <br />nonconforming structures and inspection for consideration by the Board of County <br />Commissioners at a public hearing; and <br /> <br />WHEREAS, Public notice for a public hearing to consider the amendments was provided in the <br />Daily Record on April 22, 2021 and April 29, 2021; and <br /> <br />WHEREAS, The Board of County Commissioners conducted a public hearing to consider the <br />proposed amendments on May 4, 2021; and <br /> <br />WHEREAS, At the May 4, 2021 public hearing, the proposed amendments were considered <br />and approved by the Board of County Commissioners. <br />
