LIMITED ENGLISH PROFICIENCY (ClVlL RIGHTS ACT OF 1964 TITLE Vl) a. The Subrecipient must comply with the Title Vl of the Civil Rights Act of 1964 (Title Vl) prohibition against discrimination on the basis of national origin, which requires that subrecipientJof federal financial assistance take reasonable steps to provide meaningful access to persons with limited English proficiency (LEP) to their programs and services. Comply'ng with the requirement to provide meaningful access for persons with LEp may entait proviOing language assistance services, including oral interpretation and written tianslation. Executive Order 13166, lmproving Access to Services for Persons with Lim1ed English Proficiency (August 11, 2000), requires federal agencies to issue guidance to recipienis, assisting such organizations and entities in understanding their languagg access obligations. DHS published the required recipient guidance in April 2011, DHS Guidance to Federal Financial Assistance Recipients Regarding Title Vl Prohibition Against National Origin Discrimination Affecting Limited English Proficient Persons, 76 feO. Reg. 21755-21768, (April 18,2011). The Guidance provides helpfulinformation such as how J recipient can determine the extent of its obligation to provide language services, selecting language services, and elements of an effective plan on language assistance for LEp persons. Subrecipients are encouraged to perform and document their analysis of the most appropriate language assistance services necessary to ensure a LEP individual has meaningful access 1o the Subrecipient's programs and activities. The analysis should consider i. The number or proportion of LEP individuals eligible to be served or likely encountered by the program ii. The frequency with which LEP individuals come in contact with the program iii. The nature and importance of the program, activity, or service provided by the program to people's lives iv. The resources available to the program and costs EMPG PROGRAM SPECIFIC REQUIREMENTS The Department receives EMPG funding from DHS/FEMA, to assist state, local, and tribalgovernments to enhance and sustain all-hazards emergency management capabilities as authorized by Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended (42 U.S.C. $S 5121 et seq.) and section 662 of the Post Katrina Emergency Management Act (6 U.S.C. S 762). A portion of the grant program is passed through to local jurisdictions and tribes with emergency management programs to supplement their local/tribal operating budgets to help sustain and enhance emergency management capabitities pursuant to Washington Administrative Code (WAC) 118-09. a. The Subrecipient shall use the EMPG funds authorized under this Agreement only to perform tasks as described in the Work Plan (Attachment D) and the Subrecipient's approved application for funding, incorporated into this Agreement. b.
