Confirmed Noise Violations shall be verified using the Class 1 device and handled <br /> as follows: <br /> i. First Confirmed Noise Violation (Class 1)—Compliance letter and $500 <br /> fine. <br /> ii. Second Confirmed Noise Violation (Class 1)—Compliance letter and 60- <br /> day permit suspension. <br /> iii.Third Confirmed Noise Violation (Class 1)— Revocation of the STR permit <br /> for a period of 365 days. <br /> c. All Confirmed Noise Violations are measured on a rolling twelve (12) month <br /> period beginning from the date of the first confirmed violation letter for each tier. <br /> d. Failure to install, maintain, or provide reports from the required monitoring device <br /> (Class 2 or Class 1)within 30 days of a written request shall itself constitute a <br /> Confirmed Noise Violation. <br /> e. Unsubmitted reports within 30 days of a written request will result in a confirmed <br /> violation determination. <br /> f. Noise levels at 80 decibels or above that extends beyond a (30)thirty-minute <br /> window, as indicated by the noise monitoring device shall constitute a violation. <br /> g. Once required, Class 1 device upgrades shall be in place until the owner receives <br /> no confirmed violations for a period of 6 months following confirmation of <br /> installation. <br /> 2. Any three committed violations of non-noise related standards established in this Title, <br /> shall result in revocation of the STR permit for 365 days. <br /> 17.63.070 Appeals. <br /> Any appeals of a Short-term rental determination shall be processed in accordance with <br /> Chapter 15A.07 KCC. <br />
