Department of Commerce: Submittal ID 2026-S-11466 <br />Adequate state notifications <br />We recommend including procedural guidance within development regulations to help ensure the <br />county's timely submittal of required notifications, including notice to state agencies, per RCW <br />36.70A.106 20 Failure to provide required notice and review opportunities may constitute a <br />procedural violation which can invalidate legislative actions. As a general reminder: <br />• Provide the state with at least 60 days notice before amending comprehensive plans or <br />development regulations, as required by RCW 36.70A.106. Submit copies of adopted plans <br />and regulations to Commerce within 10 days after final adoption, pursuant to RCW <br />36.70A.106(2). <br />• Per RCW 36.70A.067, the effective date for decisions to: create or expand a LAMIRD, <br />UGA, or master planned resort; establish a new fully contained community; or remove <br />designated resource lands, must not go into effect until 60 days after notice of the decision <br />has been published, or in cases where a petition has been filed with the Growth <br />Management Hearings Board, once the case is resolved. Commerce interprets RCW <br />36.70A.067 as publication in the newspaper.
