Secretary - Sectetaty of DOC or his/her designee. <br />Sending Jurisdiction - County or DOC, whichever has an hcarcerated hdividual that they want the <br />other to house, <br />Article II <br />RIGHTS AND OBLIGATIONS <br />All rights and obligations of the Parties to this Agreement shall be subject to and governed by the special <br />terms and conditions contained in the text of this contract instrument and HIPAA AND DATA <br />SECURITY REQUIREMENTS, attached hereto as Attachment A. <br />Article III <br />TERMOFTHE COMPACT <br />Section 3.01 Term. <br />The term of this Compact shall begin JuIy 01,2026, and continue until terninated <br />as providecl below, <br />Section 3,02 Termination. <br />This Agreement may be terminated by any party, for cause/ non- appropriation of <br />funds, or convenience, on thirty (30) days writtsr notice, delivered to the County Jail <br />Director or the Contracts Administrator of DOQ as apptopriate, Within 30 days after <br />the delivery of said notice, the Receiving lurisdiction/Sending Jurisdiction shall retake <br />physicalcustody of their respective Incarcerated Individualsbeing housed atthe other's <br />Facility pursuant to this Agreement, The requirement of written notice will not apply <br />i-f the Receiving furisdiction/Sending Jurisdiction, in its sole discretio& determines the <br />cause .for ternination creates an immediate threat to public safety, health, or welfate. <br />Section 3,03 Termination Due to Unavailablllty of Funds. <br />The payrnent of money by the Sending Jurisdiction under any ptovisions hereto is <br />contingent upon lhe availability of funds appropriated to pay the sums purzuant to this <br />Agreement. I-r the event funding for this Agreement becomes unavailable, withdrawn, <br />reduced, insufficient, or limited in any way the Receiving ]urisdiction shall have ihe <br />right to terminate this term of this Agreement without penalty and without the thirty <br />(30) day notice period" except for services already provided. <br />Section 3.04 Intrastate Conections Compact. <br />The provisions of the Intrastate CorrectionsCompact, pursuant to RCW 72,76, are <br />hereby made an integral part of this Compact and no ptovision of this Compact shall <br />be construed io any manner inconsistent with historical intent and the provisions of <br />the Intrastate Corrections Compact. <br />Article IV <br />SENDING JURISDICTION RESPONSIBILiTIES <br />Wastrington State <br />Department of Correcdons <br />Page 2 of 11 <br />26RAD <br />K74078
