I,VHEREAS it is the purpose of this Compact to ma.cimize the use of existing resources and to provide aclequate facililies ancl programs for the confinement, care, treatment, and employment of Incarcerated Lrdivic{uals. Departrnent and Counly specifically find that the Agreement is necessary and desirable to provide aclequate housing and care or appropriate rehabilitation and heafment programs to the persons being trarrsferred. NOVV THEREFORE, in consideration of the terms and condihions contained herein, or attached and incorporated and made a part hereof, Department and County agree as follows: Article I DEFINITIONS Convictecl Felony lncarcerated tnclividual - A person r.vho has been convicted of a felony estatrlished by state la,,v ancl is eighteen years of age or older, or who is less than eighteen years of age, but lvhose case has been transferred by the appropriate juvenile cotrrt to a criminal court pttrsuant to RCW 13.40.110 or has been tried in a criminal court purstlant to RCW 13.04.030(1XeXv)' Extraorclinary Meclical Expense - Any medical expense beyond that rvhich is normally provicted by contract medical providers or other healrh care providers at the Facility of the Receiving ]urisdiction. Facility - Any state correctional institurtion, camp, or other unit established or authorized by lalv ttncter the jlrisc{iction of DOC; any jail, holcling, cletention, special detention, or correctional Facitity operated by County for the housing of aclLrlt Incarcerated Indir,'idtrals; or any contract Facility, operated" on behali of either Countv or DOC for the hottsing of adttlt lncarcerated h'rdividuals. lncarcerater-l Individual - A person r,rrho h.rs been charged lvitl'r and/or convicted of an offense established by applicable statute or ordinance' lncarcerated lnciividual Day - Any ctay an L'rcarcerated krdividual is in the custody oI the Receiving Jr.trisc{iction including the first day an Incarcerated tndividual is delivered to the Receiving Jurisdiction. An lncarcerated tndiviclual Day ends at midnight of the Incarcerated hdividural's release or retLlm to ilre custocly of the Sending |urisdiction. An L:rcarcerated Individual Day shall not include any day that is by state law the financial responsibility of the Receiving Jurisdiction or any other jurisdiction.
