The OH-S Award Letteris incorporated in this Agreement as Attachment C' <br />The subrecipient acknowledges that since this Agreement involves federal award funding, the performance <br />period may begin prior to thiavailabilitv oi rppropii"t"d federal funds. The subrecipient agrees that it will not <br />hold the Department, the state of wa.t'tingion, or ttre United states liable for any damages, claim for <br />reimbursement, or any type of payment whitsoever for services performed under this Agreement prior to <br />distribution or <br />"ppropiilted <br />teoerit ilnos, or if federal funds are not appropriated or in a particular amount' <br />A. STATEAruOTEOERALREQUIREMENTSFORDHS/FEMAPREPAREDNESSGRANTS: <br />The following requirements "pprv <br />io all DHS/FEMA Preparedness Grants administered by the <br />Department. <br />1. SUBAWARDS & CONTRACTS BY SUBRECIPIENT <br />a. The Subrecipient must make a case-by-case determination whether each agreement it <br />makes for the disbursement of 24EMpG funds received under this Agreement casts the <br />party receiving tneiunds in the role of a subrecipient or contractor in accordance with 2 <br />cFR 200.331. <br />b. lf the Subrecipient becomes a pass-through entity by making a subaward to a non-federal <br />entity as its subreciPient: <br />i. The Subrecipient must comply with allfederal laws and regulations applicable to <br />pass-tnrough Lntities of 24EMPG funds, including, but not limited to, those <br />contained in 2 CFR 200. <br />ii.
