37.1.2. If any funds other than federal appropriated funds have been paid or will be paid to any person <br />for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, <br />an officer or employee of Congress, or an employee of a Member of Congress in connection with this <br />federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit <br />Standard Form-LLL, Disclosure Form to Report Lobbying, in accordance with its instructions. <br />37.1.3. The undersigned shall require that the language of this certification be included in the award <br />documents for all sub -awards at all tiers (including sub -contracts, sub -grants, and contracts under grant, <br />loans, and cooperative agreements), and that all sub -recipients shall certify and disclose accordingly. <br />37.2. This certification is a material representation of fact upon which reliance was placed when this <br />transaction was made or entered into. Submission of this certification is a prerequisite for making or <br />entering into this transaction imposed -by Section-1352, Title 31, U.S. Code. Any person who fails to file <br />the required certification shall be subject to a civil penalty of not less than $10,000 and not more than <br />$100,000 for each such failure. <br />38. FEDERAL NONDISCRIMINATION (Title VI, 42 U.S.C. § 2000d et seq.) <br />38.1. During the performance of this Agreement, the SUB -RECIPIENT agrees: <br />38.1.1. To comply with all federal statutes and implementing regulations relating to nondiscrimination <br />("Federal Nondiscrimination Authorities"). These include but are not limited to: <br />38.1.1.1. Title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et seq., 78 stat. 252 <br />38.1.1.2.49 CFR part 21 <br />38.1.1.3.28 CFR section 50.3 <br />38.1.1.4. The Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 <br />38.1.1.5. Federal -Aid Highway Act of 1973, (23 U.S.C. 324 et seq.) <br />38.1.1.6. Section 504 of the Rehabilitation Act of 1973, (29 U.S.C. 794 et seq.) <br />38.1.1.7. The Age Discrimination Act of 1975, as amended, (42 U.S.C. 6101 et seq.) <br />38.1.1.8. The Civil Rights Restoration Act of 1987 <br />38.1.1.9. Titles II and III of the Americans with Disabilities Act (42 U.S.C. 12131-12189) <br />38.1.2. Not to participate directly or indirectly in the discrimination prohibited by any federal non- <br />discrimination law or regulation, as set forth in Appendix B of 49 CFR Part 21 and herein. <br />38.1.3. To keep and permit access to its books, records, accounts, other sources of information, and its <br />facilities as required by the WTSC, USDOT, or NHTSA in a timely, complete, and accurate way. <br />Additionally, the SUB -RECIPIENT must comply with all other reporting, data collection, and evaluation <br />requirements, as prescribed by law or detailed in program guidance. <br />page 18 of 26 <br />
