under this permit do not interfere with use of the roadway by WDFW or the general public. <br />Permittee is required to immediately comply with verbal or written directives of the WDFW <br />Wildlife Area Manager concerning use of the roadway. This permit does not convey the right <br />to build roads, or store any materials, vehicles, or equipment on the roadway, except as follows: <br />None. <br />7. Vehicle Parking: All vehicles on state land must comply with the state Discover Pass law. <br />RC W 79A.80.080 <br />8. No Assignment. Neither this permit, nor the rights and obligations set forth herein, may be <br />assigned or sublet by Permittee.. in whole or in part. <br />9. Compliance with All Laws: Permittee agrees to ensure that all uses of the roadway under <br />this permit meet the requirements of all applicable„ laws, rules, regulations, and permitting <br />requirements, including,, but not limited to, those for hazardous substances and cultural <br />resources on state lands. If digging. grading, or other soil -disturbing activity is anticipated, <br />Permittee is required to submit the report of its Cultural Resources review and take other <br />measures as required by the WDFW Archaeologist before this permit can be issued. If any <br />activity on the roadway results in the inadvertent discovery of archaeological or cultural <br />resources, all activity must be stopped. Contact the WDFW Lands Agent immediately. <br />10. No WDFW Warranty or Liability: WDFW issues this permit without warranty, either <br />express or implied. regarding the suitability or condition of the roadway for Permittee's <br />purposes. Permittee agrees that it will not hold WDFW liable for any shortage or defect in the <br />roadway or on account of theft of, or damage to, the vehicles, equipment or other property of <br />Permittee, its employees or contractors. <br />1.1. indemnity: Permittee agrees to indemnify, defend, and hold harmless WDFW and its officials <br />and employees from and against any and all liabilities. losses, claims, damages, costs, and <br />expenses (including, but not limited to, attorneys' and consultants' fees) for property damage <br />and personal injury arising from any of the acts and omissions ol'Permittee, its employees and <br />contractors, and the event's participants at the roadway. These obligations will not apply to <br />the sole negligence of WDFW and, in the event of concurrent negligence, they will be reduced <br />by the proportion ol' WDFW's concurrent negligence. Neither party will be liable to the other <br />for the acts and omissions of members of the general public. <br />12. Insurance: Permittee agrees to obtain — and maintain for the term of this permit — liability <br />insurance that is sufficient to insure.Permittee and WDFW against liability for bodily injury <br />and property damage arising from all uses of the roadway under this permit, including, but not <br />limited to, the use of vehicles and equipment. Insurance will clover business customers as <br />well as the applicant. Minimum amounts of insurance are one million dollars <br />($1,000,000) for each occurrence and two million dollars ($2,000,000) aggregate. All policies <br />must name Permittee as the insured and "THE WASHINGTON DEPARTMENT OF FISH AND <br />WILDLIFE" as an additional... insured, and must carry a thirty -day notification -of - <br />cancellation clause. Acceptable insurance companies are those that are licensed to do business <br />in the State of Washington and have a Best's Long -Term issuer- Credit Rating of "bbb" or <br />higher. Permittee also agrees to obtain workers' compensation .insurance for any .work done <br />on the roadway by Permitiee's employees.
