EXHIBIT "A" <br />FIBER OPTIC ROUTE AND CONSTRUCTION TECHNIQUES <br />(See Attached) <br />The parties recognize that the construction techniques and locations listed in this Exhibit are the <br />presumed techniques and locations for LEVEL 3's construction in the COUNTY, based upon LEVEL3's <br />investigation of the route. However, the techniques and locations are subject to change in the event that <br />LEVEL 3 determines that any of said techniques are impossible or impractical at any location along the <br />proposed route. By illustration, some examples of situations where the techniques may be altered are as <br />follows: <br />• Conflicts with existing utility facilities (either longitudinal or traverse to the running line) <br />• Poor subsurface ground conditions <br />• Conflicts with drainage structures or other facilities to be avoided or preserved <br />• Poor surface water conditions at the time of construction <br />• Permit restrictions from relevant monitoring agencies (i.e. wetland/habitat) <br />In the event that LEVEL 3 must utilize different construction techniques or install its facilities in different <br />locations than those identified in this Exhibit, it will promptly notify the Director of Public Works (or his <br />designee) for approval, which will not be unreasonably withheld or delayed. <br />FRANCHISE PAGE 8 OF 6 <br />
