4. <br />AR = BR x (1 + ((CPIp I CPIzozs) -l)), where: <br />AR: Adjusted Rate effective October I <br />BR: Base Rate shown in (a) through (e) above <br />CPIp = CPI as of April of the year of adjustrnent <br />CPIzozs * CPI as of April2025 <br />CPI means the Consumer Price Index for All Urban Consumer for the West Region <br />(Series CUUR0400SAO, CUUS400SA), for all items, not seasonally adjusted, , as <br />published by the United States Department of Labor, Buteau of Labor Statistics, or <br />any other appropriate index as may be mutually agreed upon by the parties hereto. <br />For exarnple, if BR is $50.00, CPI for Aprtl2026 is 184.3, CPI forApril2025 is <br />177.O,AR for the year starting October I,2026 would be calculated as follows: AR= <br />$s0.00 X (l + ((184.3tr77.0) -l): $sl.6s. <br />(d) No 2025 CPI Adiustment. <br />The Parfies acknowledge and agree that there shall be no CPI Adjustmer$ of Fees <br />pursuant to Section 5(e) in 2025. <br />Section 6. Term and Effective Date. <br />Pursuant to Section 6(b), the term of the Agreement is hereby extended for a period of <br />thirty (30) months, beginning on July 1,2A25 and ending on January 1,2028. <br />5. Recvclable Material Containers. <br />Section (c), the subsection titled 'Recyclable Materials", is amended to add a third <br />paragraph as follows: <br />"Effective as of July 1,2025,the Recyclable Material containers shall be for use <br />by Residential Customers only. " <br />6. Section 8. Hours and Davs of Onerations. <br />Section 8, paragraph 6 of the Agreement is hereby deleted in its entirety and replaced <br />with the following: <br />"For any closure to the general public or to waste hauling companies, the <br />Company shall post a Notice of Closure at the entrance to each transfer station at <br />least fourteen 0 a) calendar days prior to the closure.
