All instances of the term, "commercial customer" in the Agreement is hereby replaced with "Commercial Customer". (z)Transfer Station means those transfer stations contemplated by this Agreemont, including the Upper County Transfer Station, the Ellensburg Transfer Station, and the New Ellensburg Transfer Station. All instances of the term "transfer station" in the Agreement is hereby replaced with "Transfer Station". 3- Section 5. Compensation. (a) Uodates to Base Rates. The Base Rates set forth in Section 5, Compensation, subsections (a) Comprehensive Operations Fee; (b) Yard Waste and Tire Transportation Fee; (c) Inert Demolition and Construction Debris Transportation Fee; and (d) Recycling Drop Box Hauling Fee are hereby amended as set forth in Exhibit A: Rate Sheet. fb) Recvclins Droo Box Hauline Fee, Section 5(d), Recycling Drop Box Hauling Fee, is deleted in its entirety and replaced with the following: "For each Rerycling drop box hauled from a Transfer Station and returned empty, the Company shall be paid by the County at the rates set forth in Exhibit A: Rate Sheet. Each load shall be weighed at the County-operated Transfsr Station scale as the loaded vehicle leaves the Transfer Station. In addition, the Company shall weigh at the Transfer Station scales all recycling received by curbside collection within the County." (c) Chanee to CPI Adjustment lansuaee . Section 5(e), Adjustrnent of Fees, is hereby deleted in its entirety and replaced with the following: " The "Base Rates" i.e., the fees listed in (a) through (d) above shall be adjusted up or down annually on October l, beginning on October 1,2026, and each subsequent year utilizing the following formula:" First Amendment to the Agreement for Operation of Transfer Stations; Hauling and Disposal of Municipal Solid Waste: Hauling of Inert Demolition Debris Waste; and Hauling, Processing, and Marketing of Recyclables Page 2 of 6
