2025 Land Development Code <br />Enabling Ordinance Page 2 <br />October 7, 2025 <br /> <br />SECTION I <br />PROCEDURAL FINDINGS <br /> <br />Whereas, <br />Whereas, <br />Whereas, <br /> <br /> <br />Whereas, <br /> <br /> <br /> <br /> <br /> <br />Whereas, <br /> <br /> <br /> <br /> <br />Whereas, <br /> <br /> <br /> <br />Whereas, <br /> <br /> <br /> <br /> <br />Whereas, <br /> <br />Whereas, <br /> <br />Kittitas County opted into the Growth Management Act (GMA), RCW 36.70A, <br />voluntarily on December 27, 1990, through Resolution 90-138; and <br /> <br />The Kittitas County GMA Comprehensive Plan was originally adopted on July 26, <br />1996, by the Kittitas County Board of County Commissioners; and <br /> <br />Kittitas County Code 15B.03.030 indicates that any interested person including <br />applicants, citizens, county commission and board members, and staff of other <br />agencies may suggest plan or development regulation amendments for annual <br />consideration by the Kittitas County Planning Commission and Board of County <br />Commissioners through the annual docket cycle; and <br />Kittitas County suspended its 2025 and 2026 docket cycles in leu of the anticipated <br />2026 Comprehensive Plan periodic update through Resolution 2025-058. Land <br />development regulation amendments are prescribed under KCC 15B.04.030 to run <br />concurrently with the annual docket cycle with the ability to run additional cycles <br />as prescribed by the Director of Community Development Services; and <br /> <br />Kittitas County Community Development Services, as instructed by the Director <br />and in accordance with KCC 15B.04.020, are proposing a list of suggested changes <br />to the Kittitas County Code outside of the docket cycle. Community Development <br />Services made these proposals readily available for review by the public in <br />Community Development Services and within the County's official website; and <br /> <br />Kittitas County filed its SEPA checklist on July 10, 2025, and issued a <br />Determination of Non-significance (DNS) for the code amendments on August 14, <br />2025, through authority of WAC 197-11-340(2), no appeals were filed; and <br />Kittitas County submitted its proposed land development code items on July 14th, <br />2025, to the Department of Commerce as required by statute and received a letter of <br />receipt on July 14th, 2025, that the docket proposal had been received and was sent <br />to other agencies for comment; and <br /> <br />Comments were received from Kittitas County Public Works and the Washington <br />State Department of Fish and Wildlife; and <br /> <br />The Kittitas County Planning Commission conducted an open record public hearing on <br />August 12, 2025, to hear testimony and take public comment on the proposed items. The <br />Public hearing was advertised on the County website and published in the newspaper of <br />record on August 7, 2025.
