5 | Page the ”first choice” proposer, then negotiations may be initiated with the “second choice” and subsequent proposers until the project is cancelled or an acceptable contract is executed. F. Acceptance of Proposal Contract The contents of the proposal of the selected consultant will become the contractual obligation if a contract ensues. Failure of the consultant to accept these obligations may result in cancellation of their selection. G. Consultant Responsibilities The Consultant will be required to assume responsibilities for all services offered in the proposal whether or not performed by the consultant. Furthermore, the consultant will be the sole point of contact for Kittitas County with regard to contractual matters, including payment of any and all charges resulting from the contract. There will be no changes in the contract without written approval of Kittitas County. H. Termination for Default The contract may be terminated at the County’s election if for any cause the consultant shall fail to fulfill in a timely and prompt manner their obligations under this agreement. The County may, upon five (5) calendar days written notice to the consultant, terminate the right of the consultant to proceed under this agreement until a cause to cure the deficiency has been fully developed by the consultant within ten (10) days of the County’s notification of default. If no satisfactory cure is made by the consultant as determined by the Solid Waste Department, the County will terminate this agreement. In the event of such termination, any work prepared by the consultant under this agreement shall, at the option of the County, become the County’s property, and consultant shall only be entitled to receive reasonable compensation for any work completed to the satisfaction of the County. III. Purpose of the Request for Qualifications & Proposal Pursuant to Chapter 173-350 WAC, Solid Waste Handling Standards, Kittitas County is seeking a consultant to ensure Solid Waste remains in compliance with handling and permit requirements: The contracted consultant will work with the Kittitas County Solid Waste Department staff to develop recommended changes and perform the tasks outlined in the Scope of Work. The applicable operating, environmental monitoring, closure and post closure planning, and financial assurance requirements must be submitted to the jurisdictional health department for review by March 1, each year.
