the Developer requests from any City employee not acting as City Light Inspector will be done <br />at Developers expense, according to the applicable rate(s) including equipment charges. An <br />invoice at the conclusion of each month will be sent to the Developer for all charges as <br />described. The City of Ellensburg will not approve the final Development permit through the <br />City of Ellensburg Community Development Department until the invoice for City Light <br />qualified electrical worker(s) has been paid. <br />2.5 Developer Crew and Equipment <br />The Developer shall provide all labor, supervision, tools, and equipment for the performance <br />of the work. Materials for contract execution shall be supplied by the City only where noted. <br />The Developer shall be responsible to verify quantities issued and supply its' own on -site <br />staging area where applicable. The minimum equipment capacity shall be sufficient to comply <br />with worst -case loading scenarios anticipated for this contract. <br />The Developer shall at all times employ workers who are qualified in their respective positions <br />per Ch. 19.28 RCW and WAC 296-46 (Electricians) and WAC 256.45. The Developer is <br />29645 <br />restricted in his selection of labor and payment therefore by certain legal requirements which <br />must be observed for compliance with the public policy enunciated in Ch. 49.28 RCW. The <br />Developer should be thoroughly familiar with all provisions of this and other related statutes <br />before commencing work on this contract. <br />At the end of each day, all clean up shall have been completed. <br />2.6 Developer Electrical Contracts <br />The Developer shall not execute a contract with any contractorto perform any work included <br />in the Agreement until a statement of contractor qualifications has been submitted to the <br />City of Ellensburg and the City is satisfied that the contractor is qualified. The Developer's <br />contractor shall cause appropriate provisions to be inserted in all subcontracts, if applicable, <br />relative to the work to require compliance by each subcontractor with the provisions of the <br />Agreement. <br />The Developer shall be fully responsible to the City of Ellensburg for acts and omissions of its <br />contractor(s) and of persons either directly or indirectly employed by them, as he is for the <br />acts and omissions of persons directly employed by him. <br />The Developer shall cause appropriate provisions to be inserted in all contracts relative to the <br />work to require compliance by each contractor with the applicable provisions of the <br />Agreement. Nothing contained in the Agreement shall create any contractual relation <br />between any Developer's contractor and the City of Ellensburg. <br />The cost of any license shall be incidental to the Agreement. <br />Page 5 <br />JOB #3450-316 FAIRGROUNDS RV PARK 3PH EXTENTION, DEVELOPERS AGREEMENT <br />
