the Developer requests from any City employee not acting as City Light Inspector will be done at Developers expense, according to the applicable rate(s) including equipment charges. An invoice at the conclusion of each month will be sent to the Developer for all charges as described. The City of Ellensburg will not approve the final Development permit through the City of Ellensburg Community Development Department until the invoice for City Light qualified electrical worker(s) has been paid. 2.5 Developer Crew and Equipment The Developer shall provide all labor, supervision, tools, and equipment for the performance of the work. Materials for contract execution shall be supplied by the City only where noted. The Developer shall be responsible to verify quantities issued and supply its' own on -site staging area where applicable. The minimum equipment capacity shall be sufficient to comply with worst -case loading scenarios anticipated for this contract. The Developer shall at all times employ workers who are qualified in their respective positions per Ch. 19.28 RCW and WAC 296-46 (Electricians) and WAC 256.45. The Developer is 29645 restricted in his selection of labor and payment therefore by certain legal requirements which must be observed for compliance with the public policy enunciated in Ch. 49.28 RCW. The Developer should be thoroughly familiar with all provisions of this and other related statutes before commencing work on this contract. At the end of each day, all clean up shall have been completed. 2.6 Developer Electrical Contracts The Developer shall not execute a contract with any contractorto perform any work included in the Agreement until a statement of contractor qualifications has been submitted to the City of Ellensburg and the City is satisfied that the contractor is qualified. The Developer's contractor shall cause appropriate provisions to be inserted in all subcontracts, if applicable, relative to the work to require compliance by each subcontractor with the provisions of the Agreement. The Developer shall be fully responsible to the City of Ellensburg for acts and omissions of its contractor(s) and of persons either directly or indirectly employed by them, as he is for the acts and omissions of persons directly employed by him. The Developer shall cause appropriate provisions to be inserted in all contracts relative to the work to require compliance by each contractor with the applicable provisions of the Agreement. Nothing contained in the Agreement shall create any contractual relation between any Developer's contractor and the City of Ellensburg. The cost of any license shall be incidental to the Agreement.
