and connects individuals to appropriate community -based services post -release. All steps are <br />designed to uphold patient confidentiality in accordance with HIPAA and 42 CFR Part 2, while <br />supporting public safety and population health objectives of the Kittitas County Jail. <br />1. Screening conducted within 14 days of intake <br />2. Positive results trigger full assessment <br />3. Referrals documented in CHCW EHR <br />4. Jail notified of next steps <br />5. Post -release referral to CHCW or partner provider <br />6. Follow-up coordination via designated care navigator <br />5. Compliance with Laws <br />CHCW agrees to provide services in accordance with: <br />Federal and State Laws: Including but not limited to HIPAA, 42 CFR Part 2, and HRSA <br />scope of project requirements. <br />FQHC Requirements: CHCW represents that this Agreement and the services provided <br />are within its HRSA-approved scope of project. <br />County Jail Policies: CHCW staff shall adhere to applicable jail safety, security, and <br />conduct policies when on -site. <br />6. Data Sharing and Confidentiality <br />Health Information: CHCW and the Jail shall execute a Business Associate Agreement <br />(attached hereto as Attachment A) and, where applicable, a Qualified Service Organization <br />Agreement (QSOA) to ensure compliance with 42 CFR Part 2. <br />Data Use: De -identified, aggregate data may be shared for performance evaluation or <br />reporting to grant funders with mutual written consent. <br />Confidentiality: Except as necessary in this Agreement's performance, or as authorized in <br />writing by a party or by law, the parties (and their employees, agents, and contractors) shall <br />not disclose to any person, institution, entity, company, or any other party, any proprietary <br />business information directly or indirectly related to a party that the other party (or its <br />employees, agents, and contractors) receives under this Agreement, or about which it <br />otherwise is aware. The parties (and their employees, agents, and contractors) also agree <br />not to disclose, except to each other, the other party's proprietary information, professional <br />secrets or other information obtained under this Agreement ("Confidential Information"), <br />unless a party receives prior written authorization to do so from the other party, or as <br />authorized by law. Nothing contained herein shall be construed to prohibit any appropriate <br />government official from obtaining, reviewing, and auditing any information, record, data, <br />and data elements to which he/she or his/her agency lawfully is entitled. Each party shall <br />ensure that its employees or agents cease using the other party's Confidential Information <br />and return any Confidential Information in its/his/her/their possession to the other party <br />immediately upon termination of its/his/her/their participation hereunder.
