3.2 Eligibility. CHPW shall confirm Members' eligibility for Covered Services upon Facility's <br />request. <br />3.3 Identification Cards. CHPW shall provide an identification card to each Member. The card <br />will display status of membership with CHPW, Member's name, Benefit Plan identification <br />number, name of Primary Care Clinic, copayment amounts, telephone number for prior approval <br />authorization requests and notifications, and the claims address. <br />3.4 Data Requirements. CHPW shall provide Facility with claim, encounter and referral format <br />requirements. <br />3.5 CHPW Insurance Coverage. CHPW shall maintain general comprehensive liability <br />insurance in the amounts of $1,000,000 per occurrence and $3,000,000 in the aggregate. CHPW <br />shall provide Facility evidence of such coverage upon Facility's request. <br />3.6 Provider Manual. <br />3.6.1 CHPW shall maintain and make accessible to Facility its Provider Manual and <br />associated infonnation, policies and procedures, on its website, www.CHPW.org. <br />3.6.2 CHPW may revise and update the Provider Manual from time to time, and shall use its <br />best efforts to provide prior notice of at least sixty (60) days for changes that substantially <br />affect Facility's obligations, reimbursement or Covered Service delivery, unless changes to <br />federal or state law or regulations or other circumstances make such advance notice <br />impossible, in which case notice shall be provided as soon as possible. Subject to the <br />termination and continuity of care provisions in Section VI., below, Facility may terminate <br />this Agreement, as set forth in Section 6.3, below, if the change is unacceptable to Facility. If <br />there are any conflicts between the Provider Manual and this Agreement, this Agreement <br />shall prevail. <br />3.7 Non -Discouragement. <br />3.7.1 CHPW shall not in any way preclude or discourage Facility from informing Members <br />of the healthcare they require, including various treatment options and whether, in Facility's <br />view, such care is consistent with medical necessity, medical appropriateness or otherwise <br />covered under the Member's Benefit Plan. CHPW shall not prohibit, discourage or penalize <br />Facility, if Facility is otherwise practicing in compliance with the law, from advocating on <br />behalf of a Member with CHPW. However, nothing herein shall be construed to authorize <br />Facility to bind CHPW to pay for any service. <br />3.7.2 CHPW shall not preclude or discourage Facility, Members, or those paying for their <br />coverage, from discussing the comparative merits of different health carriers, even if such <br />discussion is critical of CHPW. <br />3.7.3 Notwithstanding any other provision herein, CHPW shall not prohibit directly or <br />indirectly any Member from freely contracting at any time to obtain any health care services <br />2020Fad IityAgint—Template Page II of51 Contract #{Contract#)-{PRCAgreement IDI <br />
