2.11.7 If Facility willfully collects or attempts to collect an amount from Member under any <br />of the provisions outlined above, such act will constitute a class C felony under RCW <br />48.80.030(5). <br />2.12 Insurance Requirements. <br />2.12.1 Facility shall maintain the following insurance coverage limits to cover all of <br />Facility's services in the minimum amounts specified: <br />2.12.1.1 Professional liability coverage with minimum limits of Three Million Dollars <br />($3,000,000) per occurrence and Five Million Dollars ($5,000,000) annual aggregate; <br />provided that if Facility is a skilled nursing facility, then professional liability coverage <br />with limits of One Million Dollars ($1,000,000) per occurrence and Three Million <br />Dollars ($3,000,000) annual aggregate; <br />2.12.1.2 One Million Dollars ($1,000,000) per occurrence and One Million Dollars <br />($1,000,000) annual aggregate for commercial and comprehensive general liability; <br />2.12.1.3 Applicable state statutory limits for workers compensation; and <br />2.12.1.4 Any other usual and customary policies of insurance or an equivalent program of <br />self-insurance applicable to the work being performed. <br />2.12.2 By requiring insurance herein, CHPW does not represent that coverage and limits will <br />necessarily be adequate to protect Facility. Such coverage and limits shall not be deemed as a <br />limitation on Facility's liability under the indemnities granted to CHPW herein. <br />2.12.3 Facility will promptly provide CHPW notice of any cancellation, reduction, or other <br />material change in the amount or scope of such coverage. Upon CHPW's request, Facility <br />will furnish to CHPW, a certificate of insurance evidencing all of the herein specified <br />policies of insurance with limits meeting the requirements of this Agreement. <br />2.12.4 All policies maintained by Facility shall be primary with respect to any insurance <br />maintained by CHPW. Failure to maintain the required insurance constitutes cause for <br />termination of the Agreement. <br />2.12.5 The requirements of this Section 2.12 shall survive termination or expiration of this <br />Agreement. <br />III. OBLIGATIONS OF CHPW <br />3.1 Reimbursement.
