The Contractor shatt take such action as may be required to ensure futt comptiance with the provisions in the immediatety preceding paragraphs herein. 31. Preyailin€_li{age: The contractor shal.l. pay the prevaiting rate of wages to atl. workers, taborers, or mechanics emptoyed in the performance of any part of the Work in accordance with RCW 39.12 and the rutes and regutations of the Department of Labor and lndustries. The schedule of prevaiting wages rates for the Locatity or Locatities of the Work is determined by the lndustrial Statistician of the Department of Labor and lndustries. lt is the Contractor's responsibitity to verify the appticabte prevaiting wage rate. lt is understood that the Contractor is responsibie for obtaining and compl,eting atl required government forms and submitting same to the proper authorities' Disputes regarding prevail.ing wage rates sha[t be referred for arbitration to the Director of the Department of Labor and lndustries. The arbitration decision shatl. be final and conctusive and binding on al,t parties invotved in the dispute as provided for by RCW 39.12.060. 32. D,ebarment Certif The Contractor certifies that it: g2.1 ls not presentl,y debarred, suspended, proposed for debarment, declared ineLigibte or votuntarity excLuded from covered transactions by any FederaI department or agencY. g2.2 Has not within a three-year period preceding the execution of this contract with Kittitas County, been convicted of or had a civit judgment rendered against them for commission of fraud or a criminat offense in connection with obtaining, attempting to obtain, or performing a pubtic or private agreement or transaction, violation of Federat or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, fatsification or destruction of records, makingfatse statements, tax evasion, receiving stol.en property, making faise ctaims, or obstruction of justice.
