<br />First Amendment to the Agreement for Operation of Transfer Stations; <br />Hauling and Disposal of Municipal Solid Waste; <br />Hauling of Inert Demolition Debris Waste; and <br />Hauling, Processing, and Marketing of Recyclables Page 3 of 6 <br />AR = BR x (1 + ((CPIp / CPI2025) -1)), where: <br /> <br />AR = Adjusted Rate effective October 1 <br />BR = Base Rate shown in (a) through (e) above <br />CPIp = CPI as of April of the year of adjustment <br />CPI2025 = CPI as of April 2025 <br /> <br /> CPI means the Consumer Price Index for All Urban Consumer for the West Region <br />(Series CUUR0400SAO, CUUS400SA), for all items, not seasonally adjusted, , as <br />published by the United States Department of Labor, Bureau of Labor Statistics, or <br />any other appropriate index as may be mutually agreed upon by the parties hereto. <br /> <br />For example, if BR is $50.00, CPI for April 2026 is 184.3, CPI for April 2025 is <br />177.0, AR for the year starting October 1, 2026 would be calculated as follows: AR= <br />$50.00 X (1 + ((184.3/177.0) -1) = $51.65. <br /> <br /> <br />(d) No 2025 CPI Adjustment. <br /> <br />The Parties acknowledge and agree that there shall be no CPI Adjustment of Fees <br />pursuant to Section 5(e) in 2025. <br /> <br />4. Section 6, Term and Effective Date. <br /> <br />Pursuant to Section 6(b), the term of the Agreement is hereby extended for a period of <br />thirty (30) months, beginning on July 1, 2025 and ending on January 1, 2028. <br /> <br />5. Recyclable Material Containers. <br /> <br />Section 7(c), the subsection titled “Recyclable Materials”, is amended to add a third <br />paragraph as follows: <br /> <br />“Effective as of July 1, 2025, the Recyclable Material containers shall be for use <br />by Residential Customers only. ” <br /> <br />6. Section 8, Hours and Days of Operations. <br /> <br />Section 8, paragraph 6 of the Agreement is hereby deleted in its entirety and replaced <br />with the following: <br /> <br />“For any closure to the general public or to waste hauling companies, the <br />Company shall post a Notice of Closure at the entrance to each transfer station at <br />least fourteen (14) calendar days prior to the closure. The Company shall also <br />post a notice of closure on any Company social media and/or website(s) <br />applicable to the Company’s transfer station operations in the County during the <br />same 14-day period.”
