d. The County and the Funding Reclpient agree that ln fulfilling the terms and <br />conditions of thls Agreement neither shall discrimlnate on the basls of race, creed, <br />color, national origin, ags, sex, marital status, or the presence of a physical, sonsory, <br />or mental handicap. <br />e. The Services shall at all times be subject to inspectlon by and approval of the <br />County, but the County's making (or failure or delay in making) such inspection or <br />approval shall not relieve Funding Recipient of its responslblllty to perform the <br />Services in accord with this Agreement, notwithstanding the County's knowledge of <br />defective or non-complying performance, or the substantiality or ease of discoverlng <br />the same. Funding Recipient shall provide the Coun$ with sufficient, safe, and <br />proper facilities and equlpment for such inspection and free acoess to such facilities. <br />f. This contract is subject to revlew by any Federal or State auditor. Funding Recipient <br />shall promptly fumlsh tle County or its designee, or such Federal or State auditor <br />with such information related to the SeMces as may be requested by the applicable <br />govemmental entity. Funding Reciplent shall preserve and maintain all financial <br />records and records relating to performance of Servlc,es under this Agreoment for six <br />(6) years after contract termination. For suoh duration after lhe Gounty makes linal <br />payment of compensation due hereunder, Funding Recipient shall provide the <br />County acce$s to (and the County shall have the right to examine, audlt and copy, <br />with or without notice) all of Fundlng Reclplent's books, documents, paperc and <br />records related to the SeMces or this Agreement. <br />g. Funding Recipient understands and aoknowledges that Funding Recipient is sobly <br />responsible for lts own rcportrg and accounting of all state, federal, sooial security, and <br />local taxes, of every nature, arislng from Funding Recipient's performance of this <br />Agrcement. All mmpensatlon receivd by the Funding Recipient will be reported to the <br />Internal Revenue Servlce at the end of the calendar year ln accord wlth the appllcable <br />IRS rcgulatlons. <br />h. The grantee shall obligate funding towards construction of the project no later than <br />six monlhs from the time of grant execution (provirling the grantee has not submitted <br />the project as being nbanked" - COG Policy 2018{5). Obligatlon is expected to take <br />two forms: corsultant contrac'ting or contractor award. Presuming the COG <br />recommends a design only phase of a proposed Public Facllity grant, obllgation <br />requirements are met on the date of grantee signature on consuttiant deslgn <br />oontraot(s). COG recommondod cons$uction awards wlll oomplete obligation <br />requirements on the date of grantee signature on construction contracts. Failure in <br />obligating grant awards within the prescribed timeframe results ln the grant award <br />belng remanded back to COG for recommended re-purposing by the Board of <br />County Commlssloners. <br />i. The grantee is obllgated to follow Publlc Faollity Fund COG policies ln effect at the <br />tlme of grant award as reflected in the Resolution signature date authorizing reciplent <br />contracting.
