Lead Law Enforcement Clerk <br />An employee who is promoted to a higher classification, including classifications outside this Agreement, <br />shall be considered probationary at that position for a period not to exceed twelve (12) consecutive <br />calendar months from the date such promotion occurs. lf the promoted employee declines the job or the <br />Employer deems the employee to be unsuited for the job, within twelve (12) consecutive calendar months, <br />the employee shall revert to his/her former position without prejudice. Employees who promote outside <br />this Agreement to Unclassified Service within the Sheriff's Office shall not lose his/her permanent Civil <br />Service Status. The employee may request to return to his/her previous position at any time, without <br />prejudice. The move will occur within thirty (30) calendar days, or as mutually agreed. Likewise, the Sheriff <br />may determine that the employee shall be returned to their previous highest ranking Civil Service position <br />at any time, without prejudice. <br />New employees will normally start at Step 1 of the job classification. The Employer may recognize previous <br />training and experience by starting a newly hired employee at a higher rate within the salary schedule. <br />Employees will progress through the pay scale based upon years of service and subsequent evaluations. <br />Determination of step within the salary scale is at the discretion of the Employer and is not subject to <br />Article 19. <br />lf the Sheriff decides to fill a new or vacant position, seniority shall be considered provided the applicants <br />are otherwise qualified based upon training, experience, performance, and ability as determined by the <br />Sheriff. <br />ln the event a specialty assignment becomes available, the Sheriff will determine appointment to said <br />assignment. Specialty assignments may be used as a training opportunity. Employees selected for specialty <br />assignments may request to be removed from the assignment at any time or may be rotated out at the <br />discretion of the Sheriff at any time, without prejudice. <br />ARTICLE 9 - TAYOFF AND RECAIL <br />ln the event of a layoff or reduction in personnel by the Employer, employees will be laid off by <br />classification in reverse order of their seniority, provided that the remaining employees can perform the <br />work in a satisfactory manner as determined by the Sheriff. ln the event of a vacancy in the Sheriff's Office, <br />an employee who has been laid off will have the first opportunity to fill said vacancy or vacancies in the <br />order of their seniority, so long as they meet the qualifications of the position. The last employee laid off <br />will be the first person recalled. Recall rights are valid for the period twelve (12) months following the <br />layoff or reduction in personnel. Notification of eligibility shall be by registered or certified mail to the <br />employee's last known address. An employee shall have fourteen (14) calendar days from the date of <br />mailing to give notice of accepting or rejecting re-employment and shall be back on the job within fourteen <br />(14) calendar days of accepting said offer; not to exceed thirty (30) days total from date of mailing to return <br />to work or forfeit all call-back rights under this article.
