Agteement, provided that such modification does not encroach upon critical areas or materially <br />impact the storm drunage plan for RANCH ON SWAUK CREEEK. <br />20.2.6.2Inclusion of uses in addition to the permitted uses set forth in the Implementing <br />Approvals and the Master Plan, unless the additional uses represent a major change in the project <br />concept. <br />20.2.6.3Increases in the maximum clearing or impervious surface percentages under the <br />approved Master Plan, Approved Final Development Plan, Approved Preliminary Approved <br />Plan. <br />20.2.6.4 Designations or changes to the locations, widths or other aspects of access, utility or <br />other easements in the approved Master Plan, Approved Final Development Plan, Approved . <br />Preliminary Approved Plan. <br />20.2.6.5 Designations or changes in the surface water management practices and standards, <br />including the size andlor alterations to the configuration of detention facilities or tracts or other <br />standards established in the approved Master Plan, Approved Final Development Plan, Approved <br />Preliminary Approved Plan, so long as the changes provide substantially equivalent or better <br />protection for aquatic resources. <br />20.2.6.6 Modifications to Conditions of Approval set forth in this Agreement which (a) are <br />althoized in a particular Condition of Approval, or (b) if the Condition of Approval does not <br />discuss authorized modifications, then modifications which meet the approval standard set forth <br />below. <br />20.2.3 Minor Modification Apnroval Procedures. The Kittitas County Community <br />Development Services Director may approve, approve with conditions, or deny the requested <br />Minor Modification based upon the proposed modification's consistency with the objectives set <br />forth in the Agreement. Minor Modifications shall be reviewed and decided as an administrative <br />process under Kittitas County Code (KCC) 15,A., and no separate variance procedures or other <br />revision procedures, including no variances under the critical area regtilations, zoning or road <br />portions of the County Code, shall apply. Notwithstanding the foregoing, the Kittitas County <br />Community Development Services Director may circulate the requested modification to <br />appropriate County departments and officials for review and comment. The Kittitas County <br />Community Development Services Director may impose reasonable conditions as part of the <br />approval of Minor Modification. The modification if approved may be in writing or <br />incorporated through appropriate revisions or notations on the approved preliminary plat (s), <br />final plat(s) or engineering drawings, binding site plan or other appropriate documents. The <br />County shall maintain a cumulative list of all approved Minor Modifications. <br />20.3. MAJOR MODIFICATIONS. <br />20.3.1 Maior Modifications. If the Kittitas County Community Development Services <br />Director determines that an application or request does not constitute a Minor Modification, the <br />Development Agreement - Page 9 of 13
