minor in nature. Such an election or modification may include a proposed or revised phasing <br />plan for a Development Area or for the Project. <br />20.1.8 Review Procedures. The Kittitas County Community Development Services Director <br />shall veri$' the applicant's elections or modifications under Paragraph 20.1.1 and veriff no other <br />County-regulated feature has been significantly affected by the modification. The Kittitas <br />County Community Development Services Director shall not have discretion to deny an <br />Authorized Election. <br />20.2. MINOR MODIFICATIONS. <br />20.2.1 Criteria for Minor Modifications. Upon RANCH ON SWAUK CREEK's request, <br />Minor Modifications (defined below) to final plats, short plats, other Implem€nting Approvals or <br />Development Standards may be authorized by the Kittitas County Community Development <br />Services Director under the standards provided in Paragraph2}.2.2 below. A proposed <br />modification qualifies for review as a'oMinor Modification" if it: <br />20.2.2 Does not include residential densities or total units or square footages, that exceed the <br />ranges specified in the Implementing Approvals and Development Agreement for the particular <br />Development Area(s); or, if it exceeds the density ranges specified in the Master Plan and <br />Development Agreement, but includes a demonstration that any variation from the <br />limitations in the particular Development Area(s) can be accommodated by an increase or <br />decrease in another Development Area, if the modification approval includes a condition <br />requiring accommodation of this change in the other affected Development Area(s), and if the <br />County determines that this change is consistent with the overall intent of the master plan <br />and Development Agreement; and <br />20.2.3 Does not result in a reduction in the amount of open space provided in the Conditions of <br />Approval for the particular Development Area(s); or, if it does result in a reduction, but it <br />includes a demonstration that any variation from the locations of proposed open <br />space(s) can be accommodated by an equal or greater amount and function of open space in <br />another Development Area, and the County determines that this change is consistent with the <br />overall intent of the Conditions of Approval, then the County may approve (or approve with <br />conditions) a modification that results in a change in the amount of open space in a particular <br />Development Area; and <br />20.2.4 Does not include uses that represent a major change in the project concept as embodied in <br />Exhibit B, Development Agreement and Conditions of Approval; and <br />20.2.5Is functionally equivalent to, or superior to, the original standard or requirement in <br />fulfilling the intent and purpose of that original standard or requirement; and <br />20.2.6 Minor Modification Examples. By way of example, but not limitation, the following <br />proposed modifications shall be reviewed as Minor Modifications: <br />20.2.6.1Changes to the size or shape of the Development Areas or lots within RANCH ON <br />SWAUK CREEK from the size and shape set forth in Exhibit B and Master Plan to this <br />Development Agreement - Page 8 of l3
