<br />ARTICLE 11. ADMINISTRATIVE AND/OR FINANCIAL REQUIREMENTS
<br />The Subrecipient shall comply with all applicable state and federal laws, rules, regulations, requirements and
<br />program guidance identified or referenced In this Agreement and the informational documents published by
<br />DHS/FEMA applicable to the 24HSGP Program, including, but not limited to, all orlteria, restrictions, and
<br />requirements of "The U.S. 0epartrnent of Homeland Security (DNS) Notice of Funding opportunity (NOFO)
<br />Fiscal Year 2024 Homeland ,Security Grant Program" (hereafter "the NOFQ"), the Preparedness Cranta Manual
<br />FM 207-23.7-0001 April 2024 (hereafter "the Manual"), the DHS Award Letter for the Grant, and the federal
<br />regulations commonly applicable to DHSIFEMA grants, all of which are incorporated herein by reference, The
<br />DHS Award LetterI n-mpore ecLin thlsAgr'e_em-ent_as Attachrrrent_C,
<br />The Subrecipient acknowledges that since this Agreement involves federal award funding, the period of
<br />performance may begin prior to the availability of appropriated federal funds. The Subrecipient agrees that it will
<br />not hold the Department, the state of Washington, or the United States liable for any damages, claim for
<br />reimbursement, or any type of payment whatsoever for services performed under this Agreement prior to
<br />distribution of appropriated federal funds, or if federal funds are not appropriated or in a particular amount,

<br />a, The Subreoipient must make a case -by -case determination whether each agreement It makes for
<br />the disbursement of 24HSGP funds received under this Agreement casts the party receiving the
<br />funds in the role of a subrecipient or contractor In accordance with 2 CFR 200.331.
<br />b, If the Subrecipient becomes a pass -through entity by making a subaward to a non-federal entity
<br />as Its subreclpient:
<br />The Subrecipient must comply with all federal laws and regulations applicable to pass -
<br />through entities of 24HSGP funds, Including, but not limited to, those contained In 2 OF'R
<br />200,
<br />The Subrecipient shall require its subreoipient(s) to comply with all applicable state and
<br />federal laws, rules, regulations, requirements and program guidance identified or referenced
<br />in this Agreement and the Informational documents published by OHS/FEMA applicable to
<br />the 24HSGP Program, Including, but not limited to, all criteria, restrictions, and requirements
<br />of the N0170, the Manual, the DHS Award Letter for the Grant in Attachment C, and the
<br />federal regulations commonly applicable to DHS/FEMA grants,
