5.3 Applicable Law: <br />This LEASE is nrade pursuant to Chapter 2.81 KCC and is subject 1o the provisions of <br />Chaptcr 59.12 RCW, each as now or hereafter amended, provided, however, that no suclt <br />amendment shall modify any of the substantive tenns hereof. <br />6. IMPROVEMENl'S: <br />6.1 Authorizcd Improvements: <br />Lessee has the right to construct or maintain a private aircraft hangar and othcr aviation- <br />related improvements ou the premises as specified in Exhibit C. All buildings, trade <br />fixture.s and other improvements to the leased property by LESSEE shall conform to <br />applicable niles, regulations, building and fire codes, and will comply with thc Minimum <br />Standards for private hangars at the Kittitas County Airporl (Kinitas County Code Titie <br />l9 as cun'ently existing or as modified). LESSEE shall procure all building and other <br />pennits required by law prior to comlnencetnent of building. All buildings trade fixturcs <br />and othcr inprovements shall be designed with a view toward aesthetic considerations <br />and installation shall not comntence until plans and spccifications therefore have been <br />submitted to and approved in writing by the County, which approval shall not be <br />unreasortably withheld. <br />6.2 LESSOR'SRepresentations/requirementsrelatedto ground: <br />LESSOR rnakes no representation or guarantee as to the suitability of the leased area for <br />construction of buildings, roadsi ramps, etc., and is not responsible for the costs of <br />excavation and/or removal ofany object found either above or below ground level except <br />for hazardous materials and archaeological artifacts existing prior to tenancy. <br />6.3 Title to Improvements: <br />During the term of this Lease, provided LESSEE is not in dcfault, allportions of thc <br />Improvements shallbe and remain the property of the LESSEE regardless of its status for <br />tax purposes as being real or personal propcrty' <br />6.4 Disposition of Improvements upon Terminatitln: <br />Upon termination of this lease, except as stated in sections 6.4.1,6.4.2, all itnplovements <br />remaining upon the leaserJ premises become the property of LESSOR, free and clear, <br />without any liability of LESSOR to LESSEE, The following disposition is at the option <br />of Kittitas County. <br />6.4.1 Lessee's Ability to Sell Improvements <br />A Lessee who has constructed improvements upon the leascd premises and has at <br />least one ( I ) year of the lease term remaining befbre the termination of his/her <br />LESsEE q n 7 Lnsson-/N-
