<br />Except a.s providcd in this Scction 4 and otherwise allowcd by law, LESSEE shall not,
<br />',vithout LESSOR's prior rvritten cousent, keep on or around the PRIIMISES for use,
<br />handling, transport, disposal, tl€atment, generation, storage or sale, any substances
<br />clcsignatcd as, or containing contponents designated as hazardous, dangerous, toxic,
<br />harrlful, rncriical or infectious (collectively refcned to as "l-IAZARDOUS SUBSTANC'E"),
<br />andlor is subject to regulation by any fcderal, state or local lalv, regulatiotr, statute,
<br />ordinance or mar.lagernent plan. With respect to any such HAZARDOUS SUfISTANCE,
<br />Lf:SSlrFl shall:
<br />A. Maintain on the PREMISES only rcasonable quantities of such lIAZARDOUS
<br />SUBSTANCEs as are reasonably necessary' usual, and appropriate lor the
<br />routine maintenance and operation of the Aircraft and the lmprovements.
<br />B. Within five (5) days of LESSOR's request, provide information to LESSOR
<br />regarding LESS DE's use, handling, storage, tleatment, transportation.
<br />generation, or disposal of HAZARDOUS SUBSTANCEs and provide evidence
<br />satisfactoly to LESSOR of LESSEE's compliancc with the applicable
<br />govemment regulations.
<br />C. Allow LESSOR or LESSOR's agent, representative or cousultant to come on the
<br />PREMISES as allowed in Section 5.2 to inspect LESSEE's compliance with all
<br />applicable governmental regulations regarding FTAZARDOU S S UBSTANC ES
<br />and to assess the environmental condition of the PREMISES, including, but not
<br />limited to, the imposition of an cnvironmcntal audit;
<br />D. Comply with all applicable govemmental statute.s, ordinanccs, rules, regulations,
<br />management plans and requirements regarding the proper attd lawful use,
<br />handling, disposition, transportation, generation, treatment, and disposal of
<br />HAZARDOUS SUBSTANCES.
<br />7.1 Cleanup Costs, Default and Indemnilication:
<br />LESSEE shall be fully and completely liable to LL:SSOR and shall indemnify, defend and
<br />save LESSOR harmless from any and atl cleanup costs, and any and all othcr chargcs, t:ac's*J
<br />pcnaltics (civil and criminal) imposed by any govemmental authority with respect to
<br />LESSEE's unauthorized, negligent or illegal use, handling, disposal, transpofiation,
<br />generation and/or disposal of HAZARDOUS SLJBSTANCES, in or about the PREMISES.
<br />Upon LESSEE's default under this Section 7, in addition to the rights and remedies set fbrth
<br />elsewhere in this LEASE, LESSOR shall be entitled to the following rights and remedies:
<br />A. At LESSOR's option, to sxcrcisc the remedies under the procedures set forth in
<br />Section 12; and
