<br />in the award terms and oonditlons.
<br />Artlcle XXXVII - Requlred Use of Amerlcan lron, Steel, Manufactured Froducts, and Gonstruction Materials
<br />Reclplents must oomply wlth the Build Amerloa, Buy Amerloa provislons of the lnfrastructure lnvestment and Jobs Act and
<br />E.O. 14005. Reciplents of an award of Federal financial assistance from a program for infrastructure are hereby notified that
<br />none of the funds provlded under this award may be used for a projeot for infrastruoture unless:
<br />initial melting stage through the application of coatlngs, occurred ln the United States;
<br />(2) all manufactured products used in the projeot are produced in the United Statesthis means the manufactured product was
<br />manufactured in the United States; and the cost of the components sf the manufactured product that are mined, produced, or
<br />manufaotured in the United States is greater than 55 peroent of the total coet of all components of the manufactured product,
<br />unless another standard for determining the minimum amount of dornestio aontent of the manufactured product has been
<br />established undet applicable law or regulatlon; and
<br />(3) all conshuction materials are manufactured ln the United States-this means that all manufacturlng processes for the
<br />construotion material ocourred ln the United States.
<br />The Buy America preference only applies to artloles, materials, and supplies that are oonsumed in, incorporated into, or
<br />afflxed to an infrastructure proJect. As $uch, it doee not apply to toolr, equipment, and supplies, such as temporary scaffolding,
<br />brought to the construotion site and removed at or before the completion of the infrastructure proJeot, Nor does a Buy Amerioa
<br />preference apply to equipment and furnishings, such as movable ohairs, desks, and portable computer equlpment, that are
<br />used at or wlthin the finlshed infrastructure proJect but are not an integral part of the structure or permanently afflxed to the
<br />infrastructure projeot,

<br />When necessary, recipients may apply for, and the agency may grant, a waiver from these requirements. lnformation on the
<br />process for requesting a waiver from these requiremente is on the website below.
<br />(a) When the Federal agenoy has made a determlnation that one of the followlng exceptlons applies, the awarding offlcial may
<br />waive the application of the domestic content proourement preference in any case in which the agenoy determines that:
<br />(1) applying the domestic content procurement preference would be inconsistent with the publlo interest;
