County in any quarter when said employee has received non-uniformed allowance and has been <br />assigned to uniform duty. This means that if personnel are assigned to duties requiring the wearing <br />of a uniform once in a one-month period, they are entitled to only one (1) cleaning. lf said personnel <br />is assigned two (2) or more times to perform uniformed duties during a month, they shall be entitled <br />to a maximum of two (2) cleanings. <br />19.9 The Countywill loan line deputies a standard setof handcuffs, handgun, holster, and othergearas <br />needed and as established by the Sheriff, which the employee will maintain and return to the County <br />upon the termination of said employee's service. The employee may elect to purchase his/her own <br />gear, in part or all, but it must meet requirements as established by the Sheriff. <br />ARTICLE 20 . WAIVER OF PORTION OF AGREEMENT <br />201 The expressed provisions of this Agreement may not be waived except by mutual agreement of the <br />Union and the County, and in any individual case, the affected employee. Neither the County nor <br />the Union will ask for or accept a voluntary waiver by an employee without prior consent of the other <br />party. <br />ARTICLE 21 SAVINGS CLAUSE <br />21.1 Should any section or portion thereof of this Agreement be held unlawful and unenforceable by any <br />court of competent jurisdiction, such decision of the court shall apply only to the specific section or <br />portion thereof, directly specified in the decision. Upon the issuance of such a decision, the parties <br />agree immediately to negotiate a substitute, if possible, for the invalidated section or portion thereof. <br />ARTICLE 22 LONGEVITY AND EDUGATION PAY <br />221 The Employer will compensate employees who qualify for longevity pay in conformity with the <br />schedule set forth herein below^ <br />For entry level hires, longevity is based on continuous years of service with the Kittitas County <br />Sheriff's Office, regardless of division or classification; for employees hired as a lateral transfer, <br />longevity will recognize time in service with the law enforcement agency they lateral from, based <br />either on date of hire with that agency, or date of Peace Officer certification, whichever is later. <br />Completed years of service Amount per month, above base Pay <br />5 vears 1.5o/o <br />10 vears 3% <br />15 years 5o/o <br />20 years 7% <br />22.2 Education pay is available for employees with a degree from an accredited College or University in a <br />field that directly relates to their primary responsibilities within the Sheriff's Office. lf an employee <br />qualifies, he or she must request education pay through the Sheriff in writing and provide a copy of <br />their transcript or degree certificate. Education pay will not be granted automatically or retroactively. <br />A. Determination of the job-relatedness of the degree program is at the discretion of the Sheriff <br />and is not subject to the grievance procedure. Education pay will become effective on the <br />first day of the pay period following the receipt and certification of the employee's degree <br />certificate or transcri pt. <br />20
