This bill primarily focuses on <br />changes to the development review timelines. Note: If action isn't taken by January 1, 2025, then the <br />new state timelines will automatically apply. <br />Senate Bill 5290 requires all jurisdictions to implement new code language requiring the following: <br />1. 65 days: For Administrative project decisions that do not require public notice from the deemed <br />complete date. <br />2. 100 days: For Administrative project decisions that require public notice to be from the deemed <br />complete date. <br />3. 170 days: ForNon-Administrative project decisions that require public notice from the deemed <br />complete date <br />If timelines are not met: <br />• A jurisdiction may be required to refund 10-20% of application review fees. <br />• After January 1, 2026, if a jurisdiction adopted at least three of the recommended permit <br />actions per RCW 36.70B.160(1) but is not meeting its permitting deadlines at least half <br />the time since its most recent comp. plan update will be required to adopt additional <br />measures. <br />BACKGROUND: <br />The Senate Bill was passed by legislature on May 81", 2023, with an effective date of July 23, 2023, and <br />requires an implementation date of January 1, 2025 <br />DISCUSSION: <br />None <br />FISCAL IMPACTS: <br />To Be Determined: Potential application fee adjustment and training costs <br />ATTACHMENTS: <br />Senate Bill 5290, White Paper, & Draft Code: <br />
