<br />The authorized place ofuse is owned by multiple private landowners. The intention ofthe combined applicanB is to obtain permits
<br />authorizing the use ofpublic groundwater in the requested amounts to be mitigated by a portion ofthe 1877 First Creek Water Users
<br />Association wat€r right. The 1877 water rights provide water budget neuEality, required by WAC 173-539A, for up lo 145 new domestic
<br />uses within the defined porlion ofthe Swauk Creek subbasin.

<br />PROVISIONS
<br />General
<br />Yqq the applicatrt shall record with the Kittit s County Auditor, a properly covenant as required under WAC l?3-539A-050 that
<br />restriots or prohibib trees over a septic drain field.
<br />You, the applicant sball record with tho Kittitas County Auditor, an appropriate conveyance instnrment urder which the applicant
<br />obtains an interest in Trust Water Right Nos. CS4-00648(AA)sb4-b and CS4-00648(AA)sb4-c(A) to offset consumptive use.
<br />Any valid priority calls against the source Trust Water Rigbt Nos. CSa-00648(AA)sb4-b and CS4-00648(AA)sM-c(A), based on local
<br />limitations in *ater pvailability, will result in temporary reduction or curtailment ofthe use until the priority call for water ends, or
<br />until otler miligation is supplied as provided in the water monitoring and management pian.
<br />The Department ofEcology cannot ensure that "a fonnation, a group offonnatiols, or part ofa formafion &at contains sufficient
<br />saturated permeable material to yield economioal [donestic] quantities ofwaler to wells . . ." will be encountered.
<br />The applicant and each landowner (mitigation credit purchaser) shall submit an "Assignment ofApplication or Psrmit to Appropriate
<br />or Store Water" form to the Department ofEcology describing the specific interest ofthe mitigation credit purchaser in this permit.
<br />Prior to assignment ofany portion ofthis water to a thfud pa{y, the pennittee must submit and the Deparsnent ofEcology must
<br />approve a water monitoring and management plan consistent with the plan required for the two mitigating ffust watsr righ6, CS4-
<br />00648(AA)sb4-b and CSa-00648(AA)sb4-c(A).
<br />Well Construction Requirements
<br />Because Groundwater Unit I (C4-35541) and Unit 2 (G4-35542) are marginal in nature, it is recommended that wells be located as frr
<br />from each ofthese units' westem outer boundaries as possible. A minimum 100-foot spacing &om existing wells is required in Units
<br />I and 2.
<br />Wells drilled lllgugh Groundwater Unit 3 (C4-35543) and into underlying Groundwater Unit 2 shall be required, at minimum, to
<br />have a solid casing through Unit 3. The looation and consfuction of any well proposed within the ElzzSW% of Section 34, T. 20 N.,
<br />R. l? E.W.M., must receive specific prior review and written approval ftom the Deparunent of Ecology to ensue that water levels
<br />within Unit 3 in the vicinity of the Dunford and McCallum Springs will not be lowered by pumping from the new well.
<br />Wells drilled lt:gggh Unit 4 (G4-35544) and into an underlying unit shatl be required, at minimum, to have a solid casing through
<br />Unit 4. A minimum 100-foot spacing Aom existing welts is requiled within the Unit 4 boundaries.
<br />Within ths Unit 4 boundaries, specificaliy &om the southern extent of Ilidden Valley in the NW% of Section 33, T' 20 N., R. 17
<br />E.W.M., north to the northem boundary of the proposed place of use for tlrese eight permit applications in the S7z of Section2? a:l.d
<br />extending into the SW% of Section 23, T. 20 N., R. I 7 B.W.M.
<br />Wells drilled !!4ggg.b Unit 4 into underlying groundwater units shall be cased and sealed a minimum of 100 feet into the underlying
<br />unit or to a depth identified by the Department ofEcolop technical staffduring consultation prior to drilling.
<br />Grcundwater Unit 5 (G4-35545) has rcgions where wells will encounter significant olays and likely result in low yield and slow
<br />recoverywells. Additionally,Unit5hasareasofperchedandthinsaturatedthickaesses. Tterefore,aminimumlO0-footspacing
<br />from existing wells is required in Unit 5. Ifnew water users are not able to successfrilly develop a well in Unit 5, they may instead
<br />consider drilling into an underlying groundwater udq which depending on location, may be Unit 7 (G4-35547, ceatral *9 ryttUl,
<br />Units I or 2 (south and southeast) oi Utrit 8 (G4-35548, north). Such wells shall be required to have a solid casing through Unit 5.
<br />Wells, Well Logs, and Well Construction Standards
<br />All wells conshucted in the state shall meet the conshuction requircments of WAC 173-160, titled 'Minimun Standards for the
<br />construction and Maintenance of Wells" and RCW 18.104, titled'Water Well Consfirction." Any well which is unusable,
