792CH - Courthouse Union <br />IO.4 An alternate work schedule may be granted at the discretion of the Employer <br />10.5 An employee will be entitled to overtime if the employee has actually worked in excess of 40 <br />hours in a workweek. By agreement of the Department Head/Elected Official, the employee <br />may elect to receive such overtime as either time and one-half 0-L/2l,paid or time and one-half <br />(t-I/2) compensatory time off. No employee may accumulate compensatory time off of greater <br />than 40 hours in their comp bank at any given time. Accrued unused compensatory time will be <br />carried over to the following year. Employees shall be allowed to cash out their compensatory <br />bank with the November payroll each year of this Agreement. Advance notice must be provided <br />by completing a form provided by the Employer no later than November 1't each year. Limited <br />Part-Time, Seasonal, and Temporary/Casual employees may not accumulate compensatory <br />time. <br />10.6 For the purpose of computing an employee's base hourly rate, employees working full-time <br />(forty (40) hours per week) shall be computed by dividing the monthly rate by 173.333 hours; <br />and regular part-time employees shall be computed by multiplying the hourly rate times the <br />number of hours worked. <br />ro.7 The Employer will provide a separate area within the Courthouse for employees' lunch and rest <br />periods. <br />10.8 Time Worked: PTO, compensatory time, holidays, jury duty, military leave, emergency leave, <br />medical leave, and/or other leaves of absence shall not constitute time worked for the purpose <br />of calculating overtime. <br />ARTICLE XI. HOLIDAYS <br />t7.I The following legal paid holidays shall be recognized <br />New Year's Day First day in January <br />Martin Luther King Jr. Day Third Monday in January <br />President's Day Third Monday in February <br />Memorial Day Last Monday in May <br />Juneteenth June 19th <br />lndependence Day Fourth of July <br />Labor Day First Monday in September <br />Veteran's Day November 11th <br />Thanksgiving Day Fourth Thursday in November <br />Native American Heritage Day Fourth Friday in November <br />Christmas Day December 25th <br />Two (2) Floating Holidays <br />And any day proclaimed as a legal holiday by Governor's proclamation. Whenever a legal holiday <br />falls on Saturday, the preceding Friday shall be observed as the holiday and whenever such <br />holiday falls on Sunday, the following Monday shall be observed as the holiday. <br />LL
