KITTITAS COUNTY COST -SHARE AGREEMENT FOR THE ASPECT <br />CONSULTING COST -REIMBURSEMENT AGREEMENT G4-36135 <br />This Agreement is entered into this day of December, 2024 by and between KITTITAS <br />COUNTY ("the County"), a political subdivision of the State of Washington, and Mr. Victor <br />Jansen (hereinafter collectively referred to as the "Parties"). <br />WHEREAS, the parties wish to collaborate financially for the purpose of processing <br />Kittitas County water right application G4-36135 utilizing the Washington Department of <br />Ecology's Cost -Reimbursement Program; and <br />WHEREAS, this financial collaboration is subject to the terms and conditions contained <br />in a separate agreement with Aspect Consulting, which is attached! as Exhibit A, and hereby <br />incorporated by reference; and <br />WHEREAS, the purpose of water right application G-436135 is to expand Kittitas <br />County's permit coverage so that additional County parcels can receive water mitigation issued <br />"over-the-counter"; and <br />WHEREAS, both;.parties have an interest in the outcome in permit application G-436135. <br />NOW, THEREFORE, in consideration of the premises and promises'; terms and conditions set <br />forth below, it is hereby agreed as follows: <br />1. Purpose. The purpose of this Agreement is to detail the manner in which the aforementioned <br />costs will be shared between the parties. <br />2. Shared Costs. <br />2.1. The Parties agree to divide the costs as shown in Table 1 of the Aspect Agreement <br />attached as Exhibit A. <br />2.2. Kittitas County shall create and maintain an account to hold deposit(s) from Mr. Jansen. <br />Kittitas County shall make distributions from that account directly to Aspect Consulting <br />as required per the terms of the separate and referenced agreement. The County shall not <br />advance fees on Mr. Jansen's behalf nor shall the County extend any credit to Mr. <br />Jansen. All unused funds shall be returned in a timely fashion. <br />2.3. Mr. Jensen shall deposit with the County before any work can begin. The County will <br />notify Mr. Jensen in writing if and when additional deposits must be made. No work can <br />commence or continue unless the required deposit(s) is on file with the County. <br />2.4. Any disputes regarding the type or amount of costs charged shall be disputed directly to Aspect <br />Consulting and not between the parties of this Agreement. <br />Cost -Share Agreement Page 1 of 6 <br />
