5. Docket Item 2024-05 — This item was proposed by KCCDS staff to add a definition for <br />Agritourism consistent with RCW 4.24.830. This will allow for future discussion of an <br />Agricultural Tourism Overlay Zone and associated uses. <br />• On September 1 Oth, 2024, the Planning Commission conducted a public hearing to <br />consider Docket Item 2024-05 for the 2024 Annual Amendment to the <br />Comprehensive Plan and unanimously recommended approval (4-0) to include an <br />Agritourism definition into Kittitas County Code (KCC 17.08.034 F) with eleven <br />(11) findings of fact. <br />In their findings, the Planning Commission finds that the inclusion of an <br />Agritourism definition consistent with state law is a good start and provides a <br />good basis for future review and decision, however, there should be a larger <br />community role in developing a better definition. <br />6. Docket Item 2024-06 — This item, the complete RCW 64.37, was proposed by the <br />Kittitas County's Short Term Rental Committee to establish a definition for Short Term <br />Rental. This will allow for future discussion and development of requirements for short- <br />term rentals. <br />• On September loth, 2024, the Planning Commission conducted a public hearing to <br />consider Docket Item 2024-06 for the 2024 Annual Amendment to the <br />Comprehensive Plan and unanimously recommended approval (4-0) to include <br />RCW 64.37.010 (1-11) as the Short -Term rental definition into Kittitas County <br />Code (KCC 17.08.486) with seventeen (17) findings of fact. <br />In their findings, the Planning Commission finds that the inclusion of a Short - <br />Term rental definition identified as RCW 64.37.010 (1-11) is consistent with state <br />law, without other sections of RCW 64.37, such as 64.37.020 Taxes, 64.37.030 <br />Consumer safety, 64.37.040 Short Term Rental Platforms, & 64.37.050 Liability <br />insurance. <br />In their findings, the Planning Commission also found that additional work and <br />development of a definition is warranted, as there are unintended consequences, <br />potential impacts to private property rights, and therefore a need for regulations <br />to be developed. <br />7. Docket Item 2024-07 — This item was proposed by KCCDS staff regarding parcels that <br />contain split zoning of Forest & Range 20 and Agricultural-5 zoning that also lies within <br />the City of Kittitas urban growth area. KCCDS has had discussions with the City of <br />Kittitas, who informed they will address this issue during their comprehensive plan <br />periodic update, therefore KCCDS Staff proposes to withdraw Docket 2024-07. <br />BOCC 2024 Annual Docket Study Session Staff Report Page 3 <br />October 22" a, 2024 <br />
